Dear xxx,

One month ago, I bought a new motorcycle on March 20, 2010, a 2008 Buell Lightning XB12S, from Mike at your store. When I purchased the bike, Mike showed me around your service department and also told me that you have state of-the-art equipment and 2 specialized, fully trained technicians in Buell motorcycles. I felt confident and good with his assuring presentation of your shop.

Unfortunately, in this one month, my bike has been in the shop for 2 weeks already.
The problem is that the ‘check engine’ light is coming on after a few minutes of the engine running. This happened the very same night that I took the brand-new motorcycle out of your store, and continued to happen since then.
I brought it in for a whole afternoon on March 23, 2010. Your technician said, that the computer showed a code that she did not understand. She asked me to bring the bike back for a few days so that she could talk to the factory to fix the problem.
Consequently I dropped off my bike on April the 6th with the added problem that apparently your technician had forgotten to put the washers for fixing the top cover (and to isolate vibration). The consequence was that the plastic cover got cracked and needed replacement (the parts had been ordered on April April 10, 2010). The fact that the parts were ordered on April 10 makes me question if my bike had been standing in your shop without any attention for four days. I picked up my motor cycle on April 10 after I had called xxxx xxxxx and finally was told that the bike was done and fixed.
However, that same day on my way home, the ‘check engine’ light came on again.
I took the bike back on Friday, April the 23rd, 2010, with the requirement to have it fixed once and for all. Mr. xxx xxxx assisted me as the service dept. was unattended at that time. When you appeared, you told him that you did not know why the part mentioned above had not arrived yet after almost 2 weeks.
Today, Thursday night April 29, 2010, after 1 week, I have not received ANY message at all from Harley Davidson as to the status or happenings of my motorcycle.

Dear Tim,
Just as you, I work hard for my dollars and I expect (as you would) that when you purchase a product with warranty, that the makers or representatives honor that warranty agreement with a sense of responsibility. At this time and after the various times and many days that the motorcycle has been under your responsibility, I do not see any sense of urgency or even customer service.

Please make things happen and do whatever is necessary for me to receive a motorcycle in pristine conditions; and do such in a time sensitive manner.

Ok, that was 2 weeks ago, they told me that they were going to change the "air intake controller", it did not fix the problem. One week ago they said that HD told them to change the ECM and so far I have not received any information.
What should I do , maybe legally?, please help guys.

Ask for a refund?

There used to be a phone number on the Buell site you could call, not sure if anyone is there now.

There appear to be a lot of dealers in Florida, how close are you to any of these other places:

Has ben more than 30 days since sale date.
I think that if I take my motorcycle from this dealer to another place I will be giving up my rights with them.
Is somebody expert with lemon law? I could use some expert advice.
I miss my bike so much... it is so sad that I could not even take a picture.

I just found out that lemon law does not cover motorcycles and or mopeds in Florida.

If you've seen around the site postings on back orders for parts you could have to wait on things needed to fix yours. It's claimed, as you state, that HD is involved so one would hope things will get resolved.

Not sure anything would be gained by hauling the bike to another dealer but if they aren't able to fix it that would be another next step to resolve the problem. In that case perhaps taking it to Gainesville where no rice works might get better results.

Call Rossmeyer and see what they say, or call Bumpus in Tennessee and ask their advice about going to a different dealer. Warranty is warranty and you should be able to take it to any dealer for the work (assuming it is still under warranty). It might just be that your dealer is trying to push you to go to a different place because they no longer really want to service the Buells. If not call Harley and see what they say.

I had the same problem with mine ... it was throwing codes for the idle air control (IAC). IAC was replaced but the problem persisted. A new ECM resolved the problem completely. Fortunately for me, I had much better customer service and mine was resolved quickly (they even took an ECM off a showroom bike until my new one came in).

unless things have changed ordered painted parts including plastics for buell can take up to 6-8 weeks. not saying whats going on is right just letting you know the airbox cover can take same time. not since they cracked it then i would expect them to try to find one at another shop and get it to you. i dont see how people think the plastics on these bikes need a high tq.

I ordered a 2010 Yellow Air box cover and wind screen for my 2009 Uly, parts came in six days after the order........

i got lucky to when i ordered my 06 up style airbox cover for my 04 it came in a week but its general rule of thumb that painted parts CAN take up to 6-8 weeks

factory warranty does not just apply at the dealer you bought the bike from.

i realize it is a ways away, but gainesville buell and hd is a very good shop. and sponsor here. a good friend of mine and his family own it and he is a bueller. i personally worked there for a few months while i was layed off at my shop here this winter.

Hi guys,
I would like to thank everybody that has written something on this thread, the latest information as of today 5.00pm EST, is that a new ECM was installed but the engine light continues coming on. The service manager told me that Monday he "personally" will call HD to find out about what else to do. I am almost ready to go postal,just kidding...

pull the godammed exhaust servo replace it and be done with the problem
or just file a law suit it will cost a few dollars but you will win in small claims court

Hi Brumbear, how come are you so sure about the "godammed" exhaust servo? Could you please explain to me? you can not even imagine how thirsty of knowledge I am.
On the other hand small claims court is for less than $5,000.00 greens. This xb 12s was bought for more or around $6,500.00 new to those suckers at HD.

On Monday you need to ask what the exact codes are so that other people can compare them to past problems. I would also recommend calling one of the bigger dealers and asking what you should do, chances are good that they will say bring it in and they may be able to fix the issue.

I would also talk to the dealer where you bought it and see about exchanging for another bike (if they have one) or a refund.

Ok guys, today june 1st 2010 I finally did receive back my motorcycle.
Timetable:
03/20/2010 New motorcycle delivery with check engine light on
03/23/2010 In for service whole afternoon, no repair. Bad installation of the air box cover, which as a result of this then got cracked.
04/06/2010 in again for service to fix engine light problem
04/10/2010 I called service department after not receiving any news, and Travis told me that the motorcycle had been repaired and the air box cover had been ordered. On my way home, the check engine light came on again.
04/23/2010 in for service and since this date, it has been in your service department.
04/29/2010 Email to Tim Lawler, Travis Clark and Korky as I had not received any communication whatsoever.
04/30/2010 phone call from Tim Lawler explaining that the part for repair was going to arrive Monday May 03/2010
05/05/2010 email to Tim Lawler the at 8:42am, asking for status
05/05/2010 Travis called me to say that the part that had been installed did not fix the problem and HD told them to install a new ECM. The part was due Monday 05/10/10 and should be installed next day.
05/14/10 Since nobody called to inform me on the status, I called again the service department and Mr. Lawler who answered the phone told me that they had changed the ECM, reset the TPS and that did not correct the problem either. I asked him to call me Monday 05/17/10 as soon he had any news from HD but that did not happen.
05/17/2010 I called the service department at 2:20 pm, nobody answered and the call went directly to Mr. Lawler’s voice mail, and I left a message. Until the end of business day, I still have not received any information as of the status of my motorcycle.
05/18/2010 Meeting with General Sales Manager John Brogno to solve the misery as follows:
- Mr. Brogno assigned the highest priority to my motorcycle in the Sunrise service department
- Mr. Brogno will send the motorcycle to the Fort Lauderdale store today
- Mr. Brogno or a representative will call me not later than Thursday May 20, for full information on the situation as well as an action and time plan
- Mr. Brogno will personally check the situation Thursday May 20 before flying out to Georgia
05/25/2010 I was called to inform me that the bike was ready after changing the whole fuel injection system. I did pick it up in the afternoon and riding back home I realized that it was working only in closed loop with no power after around 3500rpm.
05/27/2010 I took it back to HD Sunrise. Talked directly to the Service manager about the long misery.
06/01/2010 I was informed that the bike was ready. Looks like the technician that assembled back the bike forgot to synchronize the valve of the interactive exhaust with the open of the injection system (incredible to me).
Today around 4:30pm I picked up the bike and I have been riding since. The new ECM came with a different program for the fan, much better in my opinion. It rides beautiful, I have no more words than to say that I am very happy.
I am expecting my OPS exhaust system from Odie to arrive this week hopefully. Still the airbox cover has not arrived to the dealer(?)
Thank you all for your valuable advice and opinions.As a learning experience and advice for BUELL riders dealing with HD dealers is to document everything, try to send emails to the right persons,keep the paper trail, be nice so there is no excuse from them. Just remember , you are the customer and you have the rights. They FU%^&d up Buell and now, like it or not , they have to repair our motorcycles.

Ha Ha Ha! Jorge, that was your bike I saw on the lift when I took mine in for warrantee repairs! I have had my 09xb12ss there for warrantee stuff a few times now, and today they called me and told me that I need a new motor! They are taking care of it, but it can be frusterating. Maybe shoot an email to HD corprate... Good luck! You should come riding with us sometime, check us out in storm fronts, south florida rides
