Hey Ted..

Just remember, Bruce Lee broke his back once.. was told he would never walk again.. Check out any of his movies or the Green Hornet TV show to see how that one worked out..

Stay positive! You are going to do more than walk again, your gonna RIDE (and have sex!! - although I wouldn't recommend doing both at the same time...)

See You In September!

Hey Brian,
I play bass.. so I guess I can be in a band as well.. or was.. a lifetime ago.. Uh, as for the sex on a cruiser.. you forget, I've got one of those as well.. and yes, it can be done, but you must be very.. uh.. careful.. hehehehehe..

Damn, Ted don't listen to this discussion, I don't think you wanna have sex while riding (even a cruiser) at least for another couple of weeks..

Great to see your spirits up. Keep up the progress.
As for the doc's percentages, what's the percentage chance you will drop kick him and prove him 100% wrong? Think positive and it will happen. [: )]

Just found out my bike insurance, Metropolitan, is refusing to pay PIP even though it's on my policy. They state they won't pay because it was a motorcycle accident, well duh it's a motorcycle policy. So check your insurance everyone and see if your covered in a MOTORCYCLE ACCIDENT, even if it is a policy written for one. Sounds crazy but I can show you a letter that I have in my possesion and my sister was on the phone with them for 3 hours. Please check your policy so this will not happen to you. Insurance I pay for won't cover me, but even perfect strangers have contributed to help me.

Ted,

If they sold you a motorcycle policy in good faith then there must be some kind of professional duty of care (similar to a doctor, lawyer, engineer, etc, etc) that agent/broker must exercise in order to operate in that profession.

Check with the local state department that oversees insurance of which you had the accident in and see if they can be held negligent for failing to offer a coverage that could have been purchased that you did not know existed, OR, failing to properly advise that that coverage would not cover you in that instance.

I am never one to sue another unless it was grossly negligent but consult a lawyer that specializes in defending insurance companies as they will know the inner workings of those policies. If your state requires that broker/agent to carry "Errors & Omissions" Insurance then you may have a good case.

Can someone tell me what PIP Coverage is? I wouldn't talk about it until I know exactly what the terminology is. Its probably called something else up this way.

Ted,
I'm so sorry to hear the problem.

Here in the F'ing State of New Jersey the legislature, years ago passed a law removing PIP from any and all motorcycle insurance coverage.

Reason? Injuries were costing them too much, so they paid off the government to change the rules.

In NJ today if I, 45yrs old want to buy anything over 749cc I would have to pay $1000-$1500. And that's without any operator or rider insurance protection. Nice.

To top that off, I think there are only 2, maybe 3 companies that will cover bikes. The State has made it plain that big business WILL run the State and make ALL decisions reguarding the welfare of the motoring public. How else do they explain $176 ticket for forgetting your licence at home?

So much for competition. The State forces us to buy insurance, but then doesn't make sure it is available. Over half the State is driving without insurance due to its cost and availablity.

What ever any one of you do--never, ever move to this corrupt, garbage smelling, profiling, cancer causing state. There is nothing here that you can't find anywhere else.

As soon as I finish some personal business I'm outta here!

Okay, I'm off the box now. Sorry about that Ted, but talking about insurance just blows my mind. It is the insurance industry that will be the ruin of all of us. How many other products are we forced by law to purchase, yet never get any proper customer service? Normally, we go to another company. In this case, there ain't one.

Ted, I hope that somehow, someone figures your problem out. You gave them your money up front and honestly. It doesn't surprise me that the insurance company lied right back.

Sue the pricks for everything they've got!

Remember, Blue Ridge Parkway, June 04 or 05.

All the best.

Ted,
Before bringing a lawyer in on the PIP issue, advise your insurer that you plan on having your attorney look into the matter. Then ask that they provide in writing their exact reasons for refusing to pay your PIP claim.

I bet that will have them changing their tune in very short order. No way they can sell you PIP and then not pay it. That is what we call "fraud", and it ain't legal in any state I know. Go get 'em!

Try contacting your state's insurance commissioner. They may be able to help.

Ted, I agree with Hootowl. Before you do anything else, tell the insurance company you are calling the State Insurance Comissionar. Then call the Insurance Comissioner, and fax a copy of the appropriate passeges of your policy. In Maine, a call to the Insurance Comissioner generates an inquiry that must be responded to in, like 48 hours. The insurance company cannot ignore it.

We've sold several T shirts and hats at American Sport Bike since BF announced that sales will go towards the TedK fund. Only a few were to people that knew about it, though.

So, just in case anyone missed it the first time:

All T-shirt and hat sales profit at American Sport Bike until 4/15 go towards the TedK fund. Get 'em while the gettins good, do Ted a favor, and have something to show for it in addition to just plain feeling good about yourself.

My friend Matt came all the way from MA to see me on the weekend. It was great to see him. Looks like I'll be going to a nurseing facility in Asheville for two weeks for shoulder to get better. Insurance will only pay for so many days of rehab, so there going to stick me in old folks home. @#&%ing insurance!!! I need to sell my 00' Dodge Dakota 4x4 because it is a standard and they can only convert automatics to handicap controls. Looks like I'll sell the XB for the extra $$$ for car. The Subaru Outback has caught my eye. I've driven one before and it has AWD. I have rec'd letters from Alaska, CA and the Netherlands this past week. Thank you all so much. I'll keep ya' posted...
