What the HELL is THIS?

Did I miss the first time the Erik Buell Racing 1190 Typhoon was mentioned on BW, or is this something relatively new?

LOVE it. It's like "FUHD, I'll build an XB the way I wanted to begin with!"

Ha, my bad, I was looking at the caption from the article. Lo and behold, there's one of those typos they were talking about... so it's "Typhon", not "Typhoon" like they called it.

I dunno how I miss stuff like this. I swear, I think I'm on here practically every day M-F.

I love the fact that they spell it Erik and Eric within 15 words of each other.
I mean, how do you spell it correctly multiple times....and then spell it incorreclty multiple times in the same article.

Wether the news is true or not, I like the idea of him doing his own thing, NOT under someone else.
I dont want a CanAm, I want a Buell (or Erik Buell, or Erik Buell Racing, or whatever)

The downside of Erik going it alone is the capacity to produce in large enough numbers for it to be affordable to mere mortals.

I'd love an 1190, but I can't swing a $30-45,000 price tag for one.

Corporate sponsorship provides economies of scale. Economies of scale brings the price down.

Nobody owns (or can own) the name Erik Buell.

See Circular 34.

The name hoopla is a non-issue . . . focus on the product.

Watch the goal line.

Court, the reason the Bully Hill Winery is called what it is called is because Coca Cola bought ALL of the rights to the Taylor name. The Taylor family was not allowed to use their name in any form on any other wine they cared to produce. They weren't even allowed to put their name in small print on the label.

Unless the laws have changed (it HAS been some time since then) I would imagine the same would apply to the "Buell" name.

I guess I look as this as a businessman. Who has the most to loose from a fight?

If there is a HUGE legal battle and Harley-Davidson (who has already instructed their legal department to expend no resources to defend Buell intellectual property) gets into a protracted battle. . . .

1) How will Harley-Davidson be viewed by the masses taking on a sole individual?

2) Where could Erik Buell possibly get more worldwide industry press (anyone recall the silly "patent the sound" game that was played for media attention only?) than engaging in a battle with Harley-Davidson?

Intellectual property is a funny thing (correct me if I'm wrong Kevin) . . . if you are going to protect it you have to protect all of it . . you can't pick and choose. Some of you perhaps recall the visible instances where it appeared HD was "putting a ma and pa shop" out of business. There is no such concept of "ah shucks, they're small . . we'll ignore them and only go after the big fish".

The good part about all this is that it . . in the big picture . . makes zero difference beyond fun internet chat while the puzzle pieces are positioned.

"makes zero difference beyond fun internet chat while the puzzle pieces are positioned"

It IS fun. Given the lack of information leaking out of Erik Buell Racing (why doesn't that wikileaks guy do something productive!) rumors and speculation are all we have to talk about. It'll probably continue until the racing season starts and we have something else to talk about.

That is the most interesting thing i have read so far.

That means Honda et al can get away with patent infringement too, since there will be no challenge.

Hey Court:

In re to Buellparts.NET that's not really an accurate description of what occurred. I sent them one C&D letter and then HD killed Buell and we (all of HD) were told not to use any resources on Buell matters.

If I would have been allowed to use the resources I would have just filed a UDRP and the domain would be HD's. Mockery? Hardly.

I would have loved to take down that site but at the time I wanted to keep my job.

A lot of the money my company makes is from licensing patented processes to our competitors. You'd think HD would want to license some Buell tech to other companies, since they obviously aren't going to use it themselves. If they want to do that, they need to protect their IP.

Licensing entails "using resources".

De facto public domain Buell tech? "Open source" tech is good for motorcycling, right?
