Hey Skinstains, That's insane. Someone needs some training in defusing situations. I would have thrown the snowball when he said to throw another one. Just following orders sir. Needless to say I've rode in the backseat when the charges didn't stick. I've been on both sides of the badge, but never harassed a civy. Look how many calm cops were in that video with the one bad thinker. Even detectives need more training sometimes.

Hey Char, I'll arm wrestle with you at HC. I bet I loose. But it'll be fun anyway.

Just in case anybody wants to swerve back on track.

Mr_grumpy touched on it.

The charge was for an illegal audio recording (go back and review to news clip).
The video wasn't illegal the audio is what was claimed to be illegal.

Most likely the law goes back to illegal recording of phone conversations but becomes a convenient crutch in this case.

I believe that law needs to be modified, because I know damn well I can be audibly recorded by the police without their prior notification. Double standards, a reduction in our liberty....

Not so Mallot, they'd have to offer probable cause, or at least reasonable suspicion that you are a terrorist. Otherwise the police would be infringing on your rights against unlawful search, and it wouldn't hold up in court.

That's not to say someone wouldn't try, I have no idea what kind of relationship you have with your local law enforcement.

Some people tend to attract attention, even though they pretend to want to be left alone.

I actually get along really well with all the LEO's in my area. I nod my head when I go by, they nod theirs.

I had a man posing as an off duty LEO get into it with me over a lane change during an emergency situation, but have yet to hear anything about it....

About being recorded, every time the police emergency lights are activated, their recording devices start as well, and they are not required to inform you that you are being recorded....
At least that's one situation I can think of immediately.

All the cops I know socially as well as for other reasons carry personal audio recorders right in their shirt pocket.

They'll all tell you they have them on any time they are dealing with the public.

I'm not sure if it's 100% legal but I don't really care, go ahead and record me is my opinion. I don't have a thing to hide. In my case it was the deputy's own recording that got some (should have been all) of my charges thrown out.

PETERSBURG -- City police officers committed an error of judgment when they handcuffed an unruly kindergartner at school last spring but did not violate policy, the department's chief said Thursday. Chief Chuck Harmon said the two officers who handcuffed the 5-year-old girl were reprimanded for minor errors in handling the situation, which gained worldwide attention when a videotape of the confrontation was released. The officers were not punished for shackling the child, who had torn up a classroom and hit an assistant principal before police arrived. The cops left the girl in the car for 3hr's.

have to remember there are some really good cops that have been screwed out of their jobs by the bad ones as well. i happen to know one of them pretty well and it makes me sick every time i think of it. sucks to be an honest cop in a dirty dept!

In fact, under Maryland law what Graber did isn't actually a crime. For a recording to be illegal, one of the parties being recorded must have a reasonable expectation of privacy. A cop, acting as a cop, with his gun drawn, while standing alongside a public roadway, has no such expectation. On April 15th, Graber was released and the charges against him were dropped. As he told Miller, "The judge who released me looked at the paperwork and said she didn’t see where I violated the wiretapping law."

Graber was harassed, intimidated, illegally arrested, and jailed for an act that clearly wasn't illegal. According to Graber, the name of the judge who signed off on the raid of his parents' home doesn't appear on the warrant. As Graber told Miller, "They told me they don’t want you to know who the judge is because of privacy." If true, that statement is so absurd it's mind numbing. A judge issued an illegal warrant for police to invade the private residence and rummage through the private belongings of a man who broke no laws, and we aren't permitted to know the judge's name in order to protect the judge's privacy?

That judge needs to be held accountable, as do the cops who violated Graber's civil rights. In a just world all of them would be fired, and Graber and his parents would be compensated. It isn't enough that the charges against Graber were dropped. He was still punished for a crime he didn't commit, and his punishment serves as a deterrent for future would-be documentarians of government abuse. If the authorities are allowed to intimidate people who legally videotape public officials while those officials are on the job—and that would certainly include government agents illegally raiding, arresting, and jailing citizens—then the right to videotape public officials doesn't really exist.

Put another way, if the harassment of Anthony Graber is allowed to stand without consequences, the next time the cops beat the hell out of someone like Jack McKenna, those around him may think twice about hitting the record button on their iPhones.
