I talked to the guys from Sheriff's racing (cool guys, also race at Willow Springs with us) - they said they're getting briefed on writing up folks for non-factory exhausts AND emissions violations.

Anybody have any take on it?

I'm googling my a ss off to see if I can learn more. My streetbike hasn't been run for nearly 2 years now while I've been racing but he ll - now I gotta go and see if I can find all the crap I took off when I put on the race can, re-routed the breathers to a catch can... the usual.

????

Non-factory exhaust, intake and emissions regulations for a race bike? I would have thought race bikes were exempt, even in California. The GP bikes at Laguna are way above and beyond what you've done to the XB. I'm assuming you're talking about racing regs?

I wouldn't think the EPA is worried about race bikes and such, I think he was refering to street bikes.

In the bigger picture, while I personaly like my Vance and prefer a free-breathing exhaust,
I do find it unfair that some poor slob who can only afford a used bomb of a car has to pay hundreds of dollars to get their automotive exhaust compliant, and they'll be quickly ticketed should their car's exhaust become loud on the hiway.
Throngs of Big twins with drag pipes can blast by on the hiway and not even cause the officer to look up from writing up the financially-strapped slob in the loud car.
regardless of my own joy at getting away with loud pipes, I realize the inequity at once.

NOT for racebikes we're still good to go but the Sherriff was talking about for ALL streetbikes.

That will make a pull-over in the double fine zones here in the mountains cost well over a $1000 ticket PLUS the smog violation is FEDERAL Court. That may make 2 stops to clear the tickets.

I've got my stock exhaust in storage (found it yesterday) and the charcoal canister I took off my XB racebike - I might even have the snorkel somewhere - but I'm just pi$$y since I re-routed all my puke lines, de-snorkelized, race ECM'd and re-piped my S3 and was looking at re-licensing the beast for the street.

The Sherriff implied that it gives them a little more latitude to hammer a pulled-over rider who's getting an attitude with the officer.

No problem on the racebikes - I'm running them both on 94 octane leaded.

I'll have to see if I can find pics of the intake mods, etc based on those shown in the X1 files.

Short list - intake race mods, puke tubes routed to JAZ catch can, factory slip-on exhaust can, race ECM. ALL now illegal in CA!!! (BASTIDS)

You mean that anyone with an aftermarket exhaust is illegal??

What about all the cars/trucks with Flowmasters on them??? these are NOT factory exhaust...how are they legal???

I don't get it...How does changing an exhaust pipe, change the emmissions the vehicle spits out?

Now I could see if the bike you have originally came with a charcoal canister and a catalytic converter...then that stuff would have to stay on since those would (Could) have an effect on the emmissions...but the muffler (pipe) only restricts NOISE...doesn't it???

"Noise" is an EPA regulated emission.
Anything, "anything", related to EPA mandated compliance can be enforced if the local enforcement people choose to pursue it.

There seems to be loads of flexibility in enforcement options.

It has always been illegal to disable smog equipment (though that didn't stop me and one or two others in CA) - but if they're going to start enforcing it, it's going to get weird.

I'd like to see what the law says - maybe once a year, you put on your goodies, go to the station, get your tags renewed and then convert back... but if the county mounties are now going to check for hardware, could be ugly for many of us (come to think of it, I can't remember the last time I've seen a set of stock pipes on a bike)

BTW this is not a new thing. I got pulled over on a 1986 gsxr and got hassled about my Yoshimura exhaust back in 2000 on mount palomar.
They could not find a stamp that most newer pipes have that says "not for highway use" so they didn't ticket me for it. Just gave me a stern talking to.
Sounds like they are getting ready for a crack down. Don't be surprised if they don't hassle the H-D riders though, too many doctors, lawyers,
and other rich guys with political pull ride them. When they start they'll bust sport bike riders.

That's funny, none of the gov't vehicles in CA have smog on them , they are all exempt and special ordered from the factory sans smog equipment, perhaps a busted biker or two should get together and sue the state for compliance. It seems to me that there are a HELL of a lot more gov't vehicles in CA than motorcycles, and that they are putting a LOT mor epollutants into our environment due to lack of smog equipment than bikes are. Just another example of the absolute lunacy and hypocrisy of "our" Gov't.

Well the laws have been in effect since 1979, they just haven't been strictly enforced. Looks like the new laws may change that. I'd like to know if any of the people who work at a dealership could shed some more light on what they are seeing and how it is affecting their aftermarket parts sales and service work.

I would worry more about noise/pipe mods. I don't think a cop is going to know about catch cans and snorkels. The cops would have to be an expert on all bikes and models. They would most likely go after noise.

FYI regarding cars with aftermarket exhaust in Cali being illegal. Not necessarily so. Ever heard of CARB exempt? An aftermarket manufacturer can get a CARB executive order if they can show that the part meets Cali emissions regulations for the intended vehicle. That makes it legal to sell and install as it doesn't violate any EPA regulations. Not sure if motorcycle exhaust manufacturers have the same abilities. As for my four wheel modes of transportation, I own both a gasser and a diesel. The diesel is modded to the hilt. Makes me glad that there are no smog checks for diesels yet. Oh yeah -- both the aftermarket exhaust/intake and 110 gallons worth of fuel tanks on my truck have CARB executive orders, so they are fully compliant.

Gotta love smog laws. They make it harder & harder to keep old cars on the road so that the owner is eventually forced to sell it. Then the big factories buy them up & destroy them for smog credits. Every car they put out of commission is worth so many credits that lets the factories increase it's pollution into the air.
They want us to believe that the factories put out less pollution than the cars but I ain't buying it.
It really is all about the $$$$$

LA Times had an article recently about a rogue cop in Laguna Beach with a sound meter. If he heard a loud bike, he'd pull them over and test it from 10 ft behind the bike. If it's over the CA limit, 97, 98 dB or whatever it is, he'd either write them or give a lecture, depending on the perp's attitude or story. Stock or quite pipes, no worry (in Laguna Bch anyways).

Not sure if motorcycle exhaust manufacturers have the same abilities.

Any aftermarket manufacturer making products for use on a street going vehicle has the right to spend the money to get a CARB certification for their product. MOST don't for motorcycle applications due to the limited number of vehicles to be affected VS the outlay in cash to have their product certified.

Arizona Smog check for a bike?

I was not aware there were smog checks for bikes just yet. I know it is coming eventually but didn't know it was in place anywheres already.

Final bottom line answer: "it depends".

And that's an honest answer.
If some company or manufacturer comes up with an aftermarket exhaust that meets EPA and any local regulations and is willing to get that aftermarket exhaust certified and labeled as such then yes we will be able to ride our bikes with aftermarket exhausts.

EPA regulations are not designed to put companies out of business, even though they can when applied or enforced. They simply add to the costs of overhead and manufacture to be in full compliance.

So, it depends on if the aftermarket manufacturer is willing and able to produce a certified exhaust.

Well I know that the one we have on our bikes now are not EPA certified, so that means no we will not be able to ride our bikes! This sucks!

Ride until the enforcement starts and roadside inspections become common. In the mean time start shopping for stock parts. Rumor has it that most inspections will initially be visual only and maybe ear-hearing test only. No need to panic until it's time to panic.

And, just to make your day, in California your parts will also have to be further certified beyond EPA mandates and have the CARB/BAR certification as well.

There's reasons I moved out of California, this is one of them.

The new law makes tampering with ANY smog equipment illegal. Smog gear started showing up on vehicles in 1979. They can grab you for any changes that defeat ANY smog gear. I'm not sure what year EPA got its hooks into motorcycles. Oh, and not limited to smog...noise also.

Biggest thing here is enforcement. Some places may be big into it and others may not give a damn. Just have to wait and see.

Here in lovely France, they're very hot on non-standard exhausts, If you get pulled for a check or any other reason one of the first things they look at is the muffler, first to see if it has a E mark, if it has but it's not loud, generally they'll let you go. If it's not French homologated they can have you with a fine & an interdiction order if necessary,
This has really gone big since the scooter boom took off, due to all the kids with expansion chambers on 50cc strokers. same old thing, the many screwwed by the few!
