Effective October 1, 2008, HB 137 revises the traffic laws to create a few more penalties. This short bill was particularly focused on unsafe motorcycle activities, but it does include a provision for excessive speed. The new law also provides penalties for the first, second, third or subsequent violations. The Distribution Chart found on the FACC website will be updated to reflect the amounts for the first and second offenses in the Traffic section. The third and subsequent offense is classified as a third degree felony with a $5,000 fine and will appear in the Criminal Traffic section of the chart.

New Violations:
316.2085(2) Motorcycle or moped, wheels losing contact with ground
This is classified as a moving violation.
First Offense: the violator must pay $1,000 plus any other costs assessed for a moving violation. Second Offense: the violator must pay a fine of $2,500, plus any other applicable costs assessed for a moving violation. The person’s driver license must be revoked for a period of one year.
Third Offense: the violator will be charged with a third degree felony, punishable as provided in ss. 775.082, 775.083, and 775.084, a mandatory fine of $5,000, and the driver license must be revoked for a period of ten years.

I suspect that citations of code will not be viewed as mandatory, but merely as "suggestions". As a ATGATT kind of a guy who happens to be in the safety field I can quote laws to some people and they STILL think that just because they think the laws are stupid that they therefore:
1) don't have to follow them
2) only have to follow them when an enforcement person is nearby, and
3) are not susceptible to ANY of the possible physical (not to mention legal) ramifications that the law was intended to prevent.
Yeah, I'm old, but I didn't get old for no reason!

Thanks Slaughter- you made my day. Everything has its place... need to haul a$$?- do a track day. Want to stunt?- get off the public road. I fully support people's right to go nuts on their bike- as long as they follow the rules. There are reasons for traffic laws and licensing, and using public roads is a privilege- not a right.

Hopefully, by hitting the "problem" riders in the wallet it just might put a stop to this inappropriate behavior. Sure, they're gonna bitch about it, but as long as it forces them to take chances in a more controlled environment it will be better for everyone.

made my day too! im a long ways from there...

plus you have no idea how many times the police have raced a vehicle of mine to gage if there new cars are getting any faster. they never did end up with one that could out run my supra before i sold it. guess things must work a little different here in the boonies. as long as you arent endangering other people or making/selling drugs you can pretty much do what you want.

which is why i go out in the middle of no where. there are roads around here that have a few inches of grass sticking through all the cracks because they never get used anymore. its not hard to find a 5 mile stretch of road that you can see all 5 miles of from anywhere on it. and you even get nice clear views of all the side rodes until the corn gets more than a few feet tall.

if you have a place(huge parking lot, abandoned airstrip) to go play on that is sweet!!! i would love to come across something like that. but for me to go play in the few nice big parking lots close around here puts me alot closer to traffic and property then i care to be. even late at night.

so i pick a place i consider even more abandoned and safe. if i screw up there, im the one thats damaged.

SOmetimes I really wish I lived in a state where the government wasn't trying to run my daily life (and taxing me according for the privilege of doing so.) California is way, way out of control.

+1 for No-Rice if he has the freedom to have some fun in a relatively safe environment. Although, I wouldn't try a maneuver like that--it sure would be great to be able to stretch the legs of my 1125r once in a while without worrying about the cops or CHP giving me a ticket in the name of public safety....oh I can't wait for my track day in November..

Unless, you have the permission from the property owner to be on that parking lot doing that stuff then it's more illegal than doing it on a public road. Not only can you still be charged with reckless driving but a trespassing charge could come as well. I don't see a problem with a couple guys riding wheelies out in the middle of nowhere when there is no around to hurt but themselves. The problem I have are with the guys that act like an @ss doing that sh*t in town or one the highway where they have an "audience".

Also what I noticed are the ones talking the most crap HWYRANGER, SLAUGHTER, and REDBUELLJUNKIE all have speeds posted over 150 now isn't that the pot calling the kettle black. Practice what you preach gentlemen it appears all of you were also young, dumb and invincible in your prime also and I am sure there were a lot of "OLD FARTS" telling you what you were doing is wrong so let it go. Obviously he could see for miles even on the camera I could see for at least a mile.

Not when the speeds attained are done so on a racetrack. Big difference between operating a motorcycle at/near your or the machines limits on a racetrack and doing wheelies on a public road.

Man, I think that anyone that can master ANY type of riding deserves some level of respect. Whether its legal/illegal on a busy road or in the sticks, none of us (ok maybe a few) are leo's. Instead of being so critical of someone, just look at the thread, shrug your shoulders in disgust (in your own home), and move on. Oh and I can't afford to do as many track days as everyone else, so I speed on occasion... flame away. (Still think that was pretty slick NO Rice)

That's the point.. it doesn't have to be illegal or dangerous to others. I am very impressed with the ability of trick riders, even if it's not something I'd personally like to do. The video that was presented was on a public road (admittedly in a remote area), but with three people in the immediate vicinity of the "stunting" rider. Many of us feel it is our responsibility to point out to others that their choices may have consequences which appear to be overlooked by the actions/words being presented. Some consider it "talking crap", others may think it's the voice of reason. I think it's less about age, and more about experience... there is a time and place for everything. What age does teach is patience, the discipline of delayed gratification, and to think before opening one's mouth.

And, of course, we've all done stupid sh!+ at some time... it's our duty to try and suggest that others avoid making the same mistakes we have- because we care.

Redbuell I completely understand your point, hope I didn't come across as an a$$ just have had similar arguments on my local boards. I'm a firefighter by trade, I have seen some things that make me think differently about EVERY facet of life. Unfortunately all I have seen hasn't affected me in the ways most people assume it would. I respect the fact that almost everyone on this board has been riding much longer than I have, just disheartened that some of the bickering about habits goes beyond the one comment to bring it to the op's attention. Granted on group rides I have told people to get lost b/c of their actions/behavior simply to ease the attention brought to the group itself.

Check the profiles. Redbuell lists Jennings GP (a race track) in his favorite roads, and Slaughter has a picture of him on the race track, and I happen to know he is an accomplished road racer. The speeds may be excess, but chances are they happened on a race track! Here again you missed the point, THERE IS A TIME AND A PLACE FOR EVERYTHING!

The only thing I have said is I disagree with Rainman talking S*&t about passing someone at 165....Obviously you read my profile and yes, I have gone those speeds...ON THE TRACK. ANYONE pulls that kind of crap on public roads WHERE OTHERS ARE PRESENT have no business riding.

Bottom line, No Rice showed some cool videos of his wheelies. The other two riders he passed obviously knew he was there and were watching....NO PROBLEM...he was out in the boondocks where there is no problem. Rainman came out with the squid attitude. an attitude I would not have expected to come from him.


Now if you want to bring my name into a thread you better have your facts straight...or did you just assume because of what I do I must be shaking my finger in disapproval of this thread...if you knew me or read any other posts of mine you would know you are dead wrong...

As soon as I saw the "call law enforcement" crap I just got pissed and ranted. Damn I'm sorry. On a board like this I wouldn't expect someone making threats. It was a wheelie, not child porn or animal cruelty. He popped off probably like I did after seeing something that is stupid.

no prob rainman, I wasn't too keen on the "call law enforcement" part either, hell, on a road like that, I would stop and watch, probably take notes too, seeing as how the only wheelies I do are simply caused by the defective front wheel on these bikes...they are too light and won't stay on the ground under acceleration...

Rainman1ne- "Damn I'm sorry" It's all good... way to man-up. What I was really reacting to was the attitude of the post:

From my point of view it was a video of someone endangering three people (besides himself) and bragging about it- on a public road. That kind of reckless behavior needs to be brought to the attention of law enforcement. I didn't threaten anything, it's not my place to remove vids/posts, rather I was pointing out that the Administration may want to investigate for the sake of BadWeb's reputation/liability.

Law enforcement should not be viewed as the enemy, many of them are just like us, and they have a job to do. Honestly, when was the last time you were ticketed for something you really weren't doing?

As appalled as I was by the earlier posts, I am impressed with how this thread has turned out- I think we all have learned something.

Remember- having fun and being safe are not mutually exclusive.
