I hereby declare my intentions to take advantage of Buell's apparent abandonment of their copyright. Since there is no Buell merchandise available for purchase I will create my own Buell tshirts and merchandise for my own use. My local dealer has promised merchandise since June and is totally unconcerned that it never arrives. No HD/Buell dealers within 350 miles of my home carry any merchandise whatsoever. I have been unable to locate any stuff online (ebay included) that is even close to my size. Representatives of Buell (from this website) have promised me a shirt, but it has never arrived. I have concluded that Buell merchandise does NOT EXIST, and that they have abandoned their right to limit the use of the 'BUELL' name. So, I hereby declare that BUELL has 90 days to stock their dealerships with merchandise. After that date Buell riders are free to appropriate the Buell name for their own use. Thank you. |

Hehehehe...you must be British. . . . that's where most the knock off Buell stuff comes from. I'd suggest you contact any of the Badweb sponsor dealers....they have TONS of stuff. In fact, Liberty has some of the quite tough to get "MUSIC MATTERS - Thunderbolts - 2006 Tour" shirts for sale. Me? . . I'm headed to the post office with a stack of 9 boxes (all full of shirts, Buell literature and goodies). By the way, you've also misread the notice provisions of the United States Patent and Trademark Office. Zoom back to your codified statues and take another shot. Court P.S. - if you are a Brit you doubtless recall that one of the greatest legal battles in Buells history was fought right there in the good ol' United Kingdom when someone tired that very thing, taking over the name Buell American Motorcycles, Ltd. The battle didn't last long but it sure generated some interesting press. |

P.S. - if you are a Brit you doubtless recall that one of the greatest legal battles in Buells history was fought right there in the good ol' United Kingdom when someone tired that very thing, taking over the name Buell American Motorcycles, Ltd. You've mentioned this before Court, and you seem to pride yourself with the outcome at the same time implying some illegal practice was at hand by a bunch of Brit's. It's convenient you miss a pertinent fact though. Long before Buell were in the hands of Harley Davidson it was nigh on impossible to buy a Buell in the UK. The only ones available were brought in by motorcycle businesses that could afford to buy the odd one or two from the States and ship them here, where they had to be made legal for UK registration and comply with the 'construction and uses' law. As you can imagine this was a costly endeavour for anyone and that reflected on the final selling price too. So a group of businessmen put their heads together and imported several Buells and started selling them alongside their Titans and Corvettes, and it has to be said for what was reasonable money. They didn't just want a quick buck either. They were in it for the longer haul, probably unaware of HD's impending involvement with Buell and their soon to be realised interest in the UK market. Their well presented American themed showroom and their inventory of custom parts showed commitment, as did their full colour advertising in several prominent UK motorcycle magazines. They went further than that too, allowing every motorcycle journalist worth his salt access to one of the rarest bikes on the planet. Giving those journalists, as well as prospective buyers, a green light to thrash the tits of their demo's, they sold a good few Buells. One could easily see that these businessmen were pioneers for the Buell marque in the UK, and it was their initial efforts that deserved anything but to be frowned upon by those who seek to come later. After all, their only 'crime' was to spot a niche in the market which they tried to fill and prosper from. Under the circumstances I'd say they were fart smellers to try and ship under the name you're so proud of. Stupid they were not, and nor where they crooks. Rocket |

Rocket, I'm sure Court can defend himself, but the desire to market Buell in the UK was as much motivated by profit as it was recognition of a good product. Was there a good faith effort by this group of businessmen to secure a legitimate franchise? If not, how were any of their efforts right and just regardless of their motivation? |

In fact, Liberty has some of the quite tough to get "MUSIC MATTERS - Thunderbolts - 2006 Tour" shirts for sale. Thats all they had. Pegs, grips tank/tailbags. Things of that nature would have been nice without having to "order" them. These things are obviously available so why not stock a few so people can purchase them without waiting, I know that if I need something I need it now and will buy from whomever has it. |

Please expound as to why their practice, not their choice of wanted name, was illegal Court? They were bringing Buells into the UK before Harley had more than a 2% share in Buell. All I'm saying is it's unfair of you to make these people out to be crooks when the reality is they were astute businessmen, at one time flying the Buell flag in the UK well before the giants that crushed them. Rocketman, I'm not sure how things work in the UK, but in the US copyrighted brand names are copyrighted worldwide. Just because you are in the UK doesn't mean that the copyright isn't valid. Riddle me this, if China decided to manufacture and market Rolls Royce engines or Land Rovers in China do you think either of those companies would be upset. Now I know these guys were not manufacturing, but selling without a proper franchise is just as illegal. Just because you buy a hamburger and resell it doesn't give you the right to call your self McDonalds. |

Used to know a lady who i think worked for appleton hd, Think her name on ebay was cessnapilot or something very similar, She helped me out heaps with parts , shirts and advice, I even have a stunt team shirt now. Not sure how to find her again which is a pity, She was a top lady, but if you are in there and she remembers me,I would like to catch up on whats happening lately. I am in Australia btw so that shows the top service from appleton hd. Doc |

Buell American Motorcycles, Ltd. Sorry but I don't recall Buell ever using this name. Certainly not in the UK. Tell you what. If as Court says, one of the greatest legal battles in Buells history was fought right there in the good ol' United Kingdom, then those Brit's involved must have had a hell of a lot on their side if it was indeed such a battle. I mean, one would think if these Brit guys were nothing more than just knock off merchants a simple solicitors letter of intent toward prosecution would have been enough to scare these bad cats off. Court has a habit of shooting people down in flames for his own firm beliefs, though his agenda, other than making out Buell to be some wonderful motorcycle company who everyone wishes to emulate or copy in some manner when the truth is far from that is somewhat unfathomable. Hell you'd think Erik Buell invented the light bulb if you asked Court My first contact with things Buell were through these very people Court would have you believe were trying to take over the Buell Motor Co. They were simply there first when it came to selling Buells here in the UK. At one time such importing and shifting of units must have been pretty beneficial to Buell the small company. But hey since HD got involved on a larger scale it became a case of 'keep your hands off our power supply' thanks very much. We'll take it from here. ok my question (cuz i dont understand)is if i was to buy a bunch of buells and then go to the uk (not really going to happen) I cant sell them? Or is it i cant sell them and call them buells? Or can i not call my business buell? just asking for clairification. Also if it is that you cant buy them take them o uk and sell them then why is that illegal? i mean heck couldn't i buy a bunch of buells and sell them here in the states perfectly leagally? if not why? You can with any other car truck or motorcycle. |

I don't think the issue is with reselling Buells. You can buy as many Buells as you want as an individual. The problem comes when you represent them as an official product dealer. You as an individual can not offer direct warranty work for any Buell you sell. You also can not technically sell any Buell as new as the bikes must have been titled originally to you prior to being titled to the purchaser. I don't know the details of the UK issue. I wish I did. I am simply looking at it from the stand point of a manufacturer having control over the distribution system. There are things that an official dealership can do that a reseller can't. I applaud the Brit's efforts to bring a great bike to the UK. The problem was in the selection of a dealership name. If they called themselves Ian Cromwell's Motorcycle Resellers, I don't think there would be an issue. I would like for there to be more information on this story. Court, please step up. Inquiring minds want to know! |
