You should just go to the man, knock on the door, explain the situation, and just ask him to make it right, as you were injured, ever so slightly. The guy will call his insurance, and in a matter of days, the insurance company will be knocking on your door with a big fat check for probably 10 Large. The guy I bought my Sportster from was rear ended and did exactly this, and thats what happened. He was calm, not threatening and just explained that it would be the nice thing to do, the guy probably doesn't even know what you are going through.
