I am/was an EBR dealer and I can tell you that I have not been contacted in any way by anyone representing EBR. I have talked to other dealers and they report the same. Not even the letter that customers received. No communication from EBR since the April 15th closure. Zero, zip, nada!! | ||

Wow, Dan. So sorry to hear that. I know you've put in a huge investment in money/work/sweat/courage/love for all things Buell, and been delivered a huge, steaming, stinking pile of low-grade carbon. Sounds like the lawyer/vultures zipped it ALL up, pronto, and then, crickets. I'll guess that's probably one of the things that bother's Erik the most... even HE's gotta go mute. | ||

What exactly do you expect Erik to say at this point? (or at any point so far) What- is he supposed to say that it will all be OK, or explain where it will end up? ... There is NO information to be shared, until things happen that are out of his hands, and in the courts, he has little more knowledge of the outcome then we do probably. The assets of the company belong to the creditors and all the decisions are made by a judge. Dan what exactly do you/ did you expect to hear from EBR???, were they supposed to whisper the impending doom in your ear?, do you want the answers of what the magic 8 ball tells them the future holds? I really would like to hear what communique you think should and could come your way. I am very sorry for your losses...do you know what they will be when the smoke clears? NO you don't, do you? and they don't either. Ya know, the law is set up to try to take care of everyone involved, EXCEPT ERIK. Have you ever communicated with anybody that has worked for him, do you not think he feels for every person who has lost financially in this debacle? | ||

On the one hand, it is probably unrealistic to communicate either publicly about what happened or with us little people directly. We have heard from the receiver directly. However, the dealers made a significant commitment both financially (bikes, physical plant, media), and the non-tangibles such as putting the bikes out there to their clientele, making public statements, talking about the future. In short, things that go to personal credibility. As with Dan, those folks are out more than money. They are, potentially the people who will help resurrect any future venture and be responsible for future good will. Maybe it is my naive perspective, but a "we are doing the best we can," "sorry for your losses," "keep the faith" or something would go miles. Unless the Court specifically prohibits any communication with potential creditors, in which case that is easily communicated. Just my .02 from the frontier. I feel badly for the dealers I have talked to and for those I have dealt with. Probably even more so than I do for us owners. We have bikes that with luck, future parts availability, or re-launching will go for a long time. And we can still ride circles around most everyone on the streets. | ||

Check out some of you cheerleaders talking down to Dan. He's monetarily invested and deserves to speak if he has not received any communication directly from those handling this. Those of you asking Dan what he expects EBR to say to them? Here's an example - "We are not able to communicate specifics yet due to legal issues. but you are not forgotten. Please be patient as we navigate through this legal process. WE WILL be in touch with you". There is no excuse to not say at least that. No excuse. Stop worshipping and think. He has every right to be unhappy and dissatisfied with the lack of communication. And that does not constitute an attack Erik, so put away your holy swords. Unless you're going to fall on them out of a sense of honor. | ||

The dealer network put an awful lot of time and money into it. They should have been contacted. I know I would be very unhappy to wake up and find the rug pulled out from under me and then be left in the dark. | ||

It is crazy there has been absolutely NO contact made. I have to think Erik has been specifically forbidden from doing so by the lawyers involved. Why, I don't have a clue. Dan- have you tried contacting the lawyer in charge of the receivership? | ||

Tod662, Like some said, a simple letter or e-mail (all the dealers were on a direct e-mail list with EBR) with a brief explanation of what happened and maybe some direction of what we should do with our inventory would have been appreciated. Also some guidance on what to do if EBR customers are having issues with their bikes would seem to be something we should have been given instructions on I would think. These poor guys are feeling completely abandoned right now I can tell you from talking with them. Instead we heard about the closure from a newspaper article like everyone else. Is that how a company should treat the folks who are the ones responsible for selling your product? I can tell you this; if EBR does come back there are going to be a lot of the current EBR dealers who will not be interested in selling EBRs ever again. Why would they risk being burned twice? Many of the dealers right now are stuck with $100,000 or more of EBR inventory. Those $10,000 EBRs you are seeing right now on e-bay cost the dealers about $15,000 each. Unlike when When HD shut down Buell they actually paid the dealers extra money when they liquidated all the Buells in the fire sale. The "Buell" dealers were not out anything. I personally am okay as I was lucky in the way we structured our inventory so I will not be out much but several other dealers I have talked to are telling me they could be out close to $100,00 or more because of the closure. But as i said all we are hearing is the crickets chirping. | ||

The matter is in litigation and all dealers are creditors who are seeking money from EBR, and the only communications that can be made from EBR would have to be through counsel. This is not my opinion it is part of the state statute. So, wait wait guys, according to you an "I'm sorry" would make all the difference? Yes, yes, and now i'm going to get blasted all the more but ok so a little bit of lip service would be much more important then doing everything humanly possible to get you your investment back. (the alternative is that Erik is a heartless sob who doesn't care about your losses?) Your damn right it would be nice to have a personal explanation but now you guys are calling into question Erik's personal integrity. Dan would you rather have an i'm sorry or the monetary funds that would have to be used to make that happen. If somebody's son dies do you expect the Father to tell all the deceased friends how sorry he is for their loss? | ||

Buelliedan, I do appreciate your situation. My local dealer has filled my ear too. It really sucks for all involved. I'm not sure what Erik could have said though. I don't think he has any real inside information on how the future will play out, and if he somehow did, there would likely be real legal limitations on him sharing any of that information. Still, the process has to play out to see who may step in and do what. As for what you should do with your inventory, that largely depends on if someone steps up to try to save the brand. You however say that you wouldn't be interested in the brand anyway. I can understand that. That should probably give you some idea of what to do with your inventory though. I'm sure it's not a preferred answer, but it's what dealers and their customers are stuck with. | ||

I doubt anyone is looking for Erik Buell to personally contact them about this, but SOMETHING to the dealers to let them know what to do would probably be helpful. Or what about the owners, if they have a warranty issue, what should they do? Going silent like they have is not good press or publicity | ||

All the owners have received the letter from the attorney in charge of the receivership, I believe, that states words to the effect that if the owner has a claim against EBR for, say warranty work, they are to forward that claim to the attorney for resolution when this all goes in front of the judge. Is this not so? | ||

The only people getting a letter would be debtors. Employees are debtors. Only a dealer that had an unpaid invoice at EBR would be a debtor. The law prohibits any other communication. At least that is the way I understand it. | ||
