Here's a true story that, honestly, I'm not sure what to make of it myself.

I've got friend who own a guitar shop. In fact they used to be one of the top shops in the midwest. Like most guitar shops, a large part of their business was providing lessons. They didn't hire employees directly to provide lessons though. They contracted teachers to use their studios. This was all done according to the law and handled by attorneys and accountants that knew their stuff. This went on for many years with zero issues what so ever.

A few years ago they got into trouble with the IRS over "unpaid taxes" on these "employees". Even though the teachers were claiming their contract income and paying taxes accordingly, the IRS was claiming that these people were actually employees of the shop, and the business was liable for the taxes. After an expensive legal battle, they liquidated their business in bankruptcy with the IRS getting anything of value.

Oddly, the teachers that were contracted, and paid the taxes tried to get refunded that money, thinking that if the business was liable for the taxes, they certainly were not. No dice. The court said that everything was done correctly, and they were not due a refund.

So with their business officially liquidated, and knowing nothing else in life they started a new business as a one man shop doing nothing but lessons and repairs. This is a shell of what they used to be. The IRS however wasn't satisfied yet. They showed up at his new business to inform him that he stilled owed about $35K that wasn't covered by the liquidation. This was done with an actual IRS representative coming into his shop. Of course, being that both businesses were incorporated, things should be isolated to that business, right? Apparently not. So the IRS finds that the new business has absolutely zero assets to go after, so they go after him personally. The only real assets he has personally is his house. They were actually going to seize his house! Instead, they did a cash-out refinance and paid the $35K to the IRS out of their own pocket. Keep in mind, the IRS has now collected this tax TWICE, and is refusing to refund the other party because the taxes were paid "correctly" by the other parties.

Up to this point, it simply seemed government bureaucracy run amok, steam rolling over a small business owner. It was just baffling to all why this would happen though. There's nothing unusual about contract workers who pay their own taxes. I've been in that situation myself.

Well, more potential pieces of the puzzle seemed to fall into place with what has come out about the IRS going after TEA Party organizations. It turns out that this couple not only had donated to local Republican politicians, but also are involved with a local TEA Party organization. This is a TEA Party organization that, as part of the IRS investigating them, was asked for their "members" list.

As I stated up front, I'm not really sure what to make of all of this. I really want to believe that our government wouldn't do this to it's citizens. Then again, seeing what they did to Gibson Guitars was absolutely chilling. My friend happens to know the Gibson CEO, Henry Juszkiewicz personally BTW, and know far more than has been reported in the news.

My point with telling this story, is that it is very easy to think that the typical "little guy" citizen isn't really worth targeting by a super power sized government. I thought that myself until recently, but this just hits way to close to home. This is a friend who I've had for decades, and is not a big player in anything beyond the music scene. Even in the music scene, he is pretty much only known to insiders. At their peak, they were middle class working folks. Now they have pretty much been financially destroyed and are scratching to make ends meet every month.

I would be curious what others think of this story. I want it to not be what it looks like, but the more we find out, the worse it looks. This is NOT the country I grew up in.

This man should contact a republican representative for his state, and see about adding this to the List of IRS abuses.
BTW this if even close to recent may be news worthy, consider contacting the national FOX news group with the details and dates

This should be checked out
If enough of these stories come to light
the congress will have no choice but to act.

It's all happened to them in the past few years. Not sure if I had mentioned that they did business this way for over 20 years without it ever being questioned. I'll mention to them contacting a republican rep. and possibly contacting FOX.

It's scary having watched this unfold. None of it may any sense to me when it was happening. Suddenly, finding out about the IRS going after TEA Party groups, and finding out that the group they are part of were asked for membership lists just sends a chill down my spine to think about. Those puzzle pieces just fit too perfectly. Without actual proof, it's hard to make the accusation though. Of course, without a full blown Congressional investigation, there will be no proof. In my heart, I want it to not be true. In my analytical mind however, it's where the evidence points.

There was a CPA on the radio the other day that said that if you control the time and schedule of the contractor, that contractor is an employee by law, even if they are paid via 1099.

In other words, if you tell the contractor when and where they have to work, they are an employee. The only way someone is truly a contractor, again, according to this Tax Specialist, is if you contract them for a specific job but do not set their work schedule and just tell them the job must be complete by X date.

The scary thing is that a lot of people are starting to pay workers as contractors to get around Obamacare and other tax issues. Once again, according to this guy, if you do that you are opening yourself up to a lot of potential problems.

The way they had it set up was that they scheduled time as they saw fit, and paid rent to the shop for studio rental. I would say that you might be correct that the IRS could press the point that they were employees, but then they should also not be collecting taxes from the "employees". The fact that the IRS is double dipping, makes this whole thing stink to high heaven. Something just isn't right about the whole thing. The IRS/TEA Party scandal fits the know puzzle pieces very well. I would actually feel much better with another explanation that fit the puzzle as well. I just don't know what that explanation would be.

Is the issue possibly FICA & Medicaid/Medicare taxes rather than income taxes? Even with the IRS, isn't there a right to a review by a judge? I'm not sure about that, but it certainly should be so.

Ditch taxing income altogether. Tax consumption, aka a national sales tax. Too simple. No more IRS. Just the FBI to chase down the black marketeers.

I'm pretty sure it was about the income taxes. Even if not, it doesn't explain collecting the tax twice. They have a lawyer and an attorney who both seem to think that they did nothing wrong. I don't think they were able to appeal it to a judge, but I would have to double check on that. They did say that they fought it as far as they can though.
