Winnipeg — The Canadian Press
Published on Thursday, May. 13, 2010 2:19PM EDT

A corner-store owner has been charged with killing a shoplifter over what the victim's friend said was a can of luncheon meat.

Kwang Soo Kim, 62, has been charged with manslaughter in the death of Geraldine Beardy, 29, after a confrontation outside his Winnipeg store last September.

Ms. Beardy left the store and was hit with a weapon in the upper body, police said. She made her way to a friend's house and died five days later in hospital.

Police have never said what Ms. Beardy was believed to have stolen, but a friend said it was a small can of lunch meat.

Police were originally contemplating a charge of aggravated assault against Mr. Kim, but decided on manslaughter after consulting Crown attorneys.

The encounter touched off public debate about how far shopkeepers should go in fighting theft, and prompted police to warn people not to get involved in physical confrontations unless absolutely necessary.

Mr. Kim's lawyer said his client is holding up well.

“I think he's doing as well as could be expected,” Evan Roitenberg said Thursday. “Obviously, he was hoping he wasn't going to be charged and is not thrilled to be facing such a charge.”

Ms. Beardy was from the Garden Hill First Nation, 600 kilometres north of Winnipeg, and was in the city for medical treatment.

just for a can of food... so sad

Yeah he should have just let her leave with whatever she stole. It doesn't matter that the store is probably his method of feeding HIS family. Heck, he should have just tossed her the keys to his car so she wouldn't have to walk.

Thats a tough one because of lack of details. She should have not been stealing, but does not deserve to die because of it. The weapon used is not specified either. Maybe Mr. Kim just happened to hit her in the right spot. Obviously she had internal bleeding or something. He probably hit her with some sort of blunt object, and happened to find an unfortunate sweet spot. Tragedy on both sides of this story.

There are consequences with every action, if you are going to commit a crime then be ready to accept the punishment however harsh it may be. She was the one who made the decision that sealed her fate, so she alone should be held responsible for her death.

+1 Where is the outcry for people who are perpetually victimized by thieves and the like. Sometimes people just get sick and tired of it. Always an outcry for the vigilante, but never an outcry for what he's been through. How many times have people took food out of his kids mouth by stealing? Someone wrongs you enough you're gonna fight back. Maybe a little harsh for 1 can of food (maybe she needed it badly..) but thats what society has come down to. People feel like they can do whatever they want and get away with it. Just like people chiding me for saying I'd blast someoen trying to take my Firebolt. Been victimized too many times and I ain't gonna take it anymore.

Thieves get what they get.

In prison, thieves are ranked just above child molesters.

When the get on the yard, they are lectured by a shot caller, they get one chance. If they steal anything from anybody, they get stomped out.

This person just happened to incur the wrath of an indignant shopkeeper who most likely struggles to keep his head above water. She might have tried ASKING for help, he may have been sympathetic. But since she ASSUMED that she could get away with STEALING she got exactly what she paid for.

I'll still pray for both of them anyway.

Paw said what we were all thinking...

I've got a truck in Canada right now, enroute to Fairbanks Alaska. My Canadian bond agent was extremely helpful, sweet as pie. Sounded cute, too... and only charged me $175 Canadian to clear $246,000USD of cargo to pass through.

Hopefully my drivers won't get mugged at the truck stop in Prince George. Stay tuned.

I wonder why they didn't verify what was stolen with the shop owner. It very well could have been over more than a can of meat.

Probably slashed her with a hockey stick. Those things should be banned and confiscated! I still carry a scar from one of those!

If it were such dire straights... and she was such a good friend... maybe the friend should have paid for the can of SPAM.

We are here to kill your daughter
What?
Well you have three of them, so obviously you wont miss one.

(stupidity of scale, there were only three cans of SPAM on the shelf, surely he wont miss one)

I am hoping that everyone goes and sees Robin hood and we have a full summer of govt lash back with arrows..... (was that my outside voice?)

If it was just a can of meat then the shop owner was in the wrong. But I understand the shop owners thinking he did not have camera's to get a shot of her so he use his 9 mm in stead. I guess nobody told him he needed an 8 mm "camera".

T_3 are all you guys running scared up there thinking your life is in danger everytime you step in to a 7 eleven?

I'm sorry if I upset anyone with my comments.

It is sad that this stealing woman died because of the overreaction by the shop keeper.

Canadian women don't shave!

Probably one of those Canadian druggies, obviously on the public dole.

Canadian women don't know how to do dishes.

I knew a Canadian woman that when her husband smoked pot for the first time, he had to lock himself in the basement to keep from coming upstairs to kill her.

Canadian beer is expensive, and the Canadians like to drink it warm.

If I look real hard across the lake I am on right now I can see Canada, I think it smells over there.

Damn blood thirsty Canadians!

Eh?

Officers located a man on a tractor and tried to stop it, but the driver of the tractor rammed the police cruiser and shots were fired at police, Starr said. The area was then contained and that was followed by a second exchange of gunfire.

Those Canadians are crazy!

Maybe I'm wrong, but wasn't it Jay Leno who said "The only thing worse than a French man was a French man from Canada?"

He must have visited the boardwalk at Hollywood beach in Florida.

an upper body blow doesnt sound like a warrant for charge of manslaughter. If it was just an upper body blow and you cant survive that then that sounds like a personal problem.

I AM SURE THAT POLICE PERFORM UPPER BODY BLOWS on the general public on a regular and unquestioned basis. Let Mr Chin go!!!!!!!!
