Did anyone else see the rest of the yellow 'Cuda pics in Road Racing World this month? Very cool pictures, and they are one of the few magazines that's had much of anything about Buell lately. One of the few moto mags I subscribe to, highly recommended.




























Text reads, in part, "A reader finds himself in the right place at the right time and catches Erik Buell himself out for one last November ride aboard and unusual motorcycle... I got the camera back up fast enough to get this sequence of shots. It (the bike) has no markings- aside from the guy wearing the Buell jacket and the giant front rotor. But it doesn't look like any Buell I've seen before. I think this may be the 1125RR that they pulled the plug on".

Nice. Thats the bike that Harley core customers can't embrace.

Well I guess nothing is more American than the story of an individual with a dream that through blood sweat and tears came to life. Funny that Harley plays the bad guy in the american sportbike story. More proof that Harley has lost it's credibility. Long live EBR. Dethrone the American motorcycle pretenders. Give us our pride back. The only thing they're worth now is the money the give to Buell.

I got my copy in today's mail too!

Usually it seems here in Eastern NC all subscription copies come out AFTER the issue shows up on the newsstand. I saw last months issue of Road Racing World on the newsstand at least a week before my subscription copy arrived in my mailbox.

Good to know that the 'news' gets here quicker than before,

Where are we at with trying to get H-D to sell Buell? I haven't seen anything in articles on the web recently.

That's awesome that Erik was the one riding (if that's true). Man, that ride just had to be a big "F-U Harley!". Don't you know some of the corporate types just threw a conniption fit over that?

love the cuda, especially in that yellow.... now where are the rooster spy photos. I KNOW somebody has em. I still think EBR should race the MX450 in the super thump class against Yami and Roland Sands.

So..... That looks extremely cosmetic vs the current 1125r. What would stop someone from making similar bodywork and putting it on the market?

I know, I am the fat diabetic kid with a sweet tooth trapped behind the glass at Krispy Kreme when the rollers are empty and there are not to be any donuts at all.

Worse still, Santa, the EPA, Obama and local legislation are all moving to outlaw all donuts.

I believe so. Isn't that part of what they will be doing with the 1125RR?

Yeah...I can't explain the homologation mess that would follow. An approved allotment of 3000 street units from Harley would be nice.

I think patents are really less of an issue than the rights to use existing designs.

Harley owns the designs and even if nothing was patented, Erik wouldn't be able to use the existing parts and the existing designs without Harley's permission.

Hypothetically, if he had the rights to the patents and only the patents, he'd still have to start fresh and incorporate those technologies into a new bike. That new bike would have to go through rigorous testing and refinement to get close to the current bikes. It would have to get DOT and EPA certifications etc. etc. etc.

If he's forced to start over, it would be nice to have use of the patents, but the patents are a relatively minor issue IMHO. Keep in mind, the original fuel-in-frame patent is over 20 years old and expired. There is a newer patent related to (if I remember correctly) the break-away design of the front end in combination with the fuel-in-frame. So Erik could make another fuel-in-frame bike but he can't use the same break-away method (if he can think of a better way to do it - and I'd bet he can - he can patent that new technology).

The ZTL patent (I believe) is related to the mounting system for the disc, so, again, if he can figure out a better way to do it, he can still use a rim-mounted brake, it just may not be a "ZTL".

But if he could obtain the rights to existing designs - as he did with the race bikes - he could be up and building bikes within months. He can't make those existing designs without the patents (so of course that would have to be part of the rights package), but the designs are really the important thing at the moment.

Harley has said they will not make the existing designs and they won't sell them. In my mind that's an inexcusable and selfish waste.

Those designs have value to Erik. They have value to East Troy and the workers who could have jobs if the designs were released. They have value to anybody who wants a US sportbike. They have value to the US economy and the motorcycle industry in general.

But they have absolutely no value if they're not sold.

For Harley to just sit on those designs until they're useless is analgous to a king who has store houses full of food - much more than he could ever eat - but rather than letting his starving subjects have the food - that they're willing to pay for - he insists on letting it rot in his storehouses.

Nobody can tell the king he can't do that . . . but he sure would be a complete ass**** to even think about doing that.

I think an RTU (right to use) agreement would be one idea. Fairly common in the world of IP.
