My wife made me a nice sweatshirt with a Buell logo.

I'm not picking a fight, mind you, but in this case, The name Buell is used and the phrase American Motorcycles. For Buell to have a problem with it, it would most likely have the letters (tm) beside it. Also, it would need to have the oval thing around it. The patch Rusty on ATC uses, has a pegasus on it, but not the Buell Pegasus, which is OK. If he had an identical Pegasus, he would be sued. If the above sweatshirt had a Blue Oval and the phrase listed above, and made without permission, he could be sued for even wearing it. There are some funny things with name usages.

Eric himself said that he didn't mind people using the likeness as long as they didn't profit from it. The question was in relation to reproduction of the Buell racing logo and the name on race bikes, but I see this as no different.

Cochise, the problem with trademark is if someone try to make money from it without permission.

In this case this is a personal shirt that my wife did as a gift for me.... because there was no Buell shirt at my Buell dealer!

Anyway, this is not even the exact font for the Buell....

stou- as I'd said, i have no problem with your shirt. neither does cochise or erik buell, for that matter.
it's a nice shirt.
actually, though, you don't have to "make money" on someone else's design to be in violation of copyright law. someone gave you bad advice, there.
the mere act of distributing, even for free, a copyrighted logo or name
detracts profits form the company whom owns control of said logo or name, and thereby deprives them of potential monies that their tradmark/copyrighting is set up to protect.
saying that only 'making money' on a name/logo violates copyright laws is like saying it's only illegal to distribute marijuana if you're charging for it.
the violation is the violation in both cases.

I've got a Buell Pegasus tattoo on my arm. Do you think the Mothership's lawyers will try to make me get rid of it? Maybe they'll try to make me pay a Licensing Fee!

The first problem was the NOT ASKING ME part. I will apologize for the part that TO ME, it looked like somebody was trying to sell a shirt. Saying, "How do you like this shirt, it will be "X" amount and it can be delivered in "X" amount of time...." sounded TO ME, again, like it was going to be made and distributed as such. A little story about my wife and a shirt that was going to be made by U.S. Polo Association, they made a "polo" style shirt with two horses with two polo guys ridng side by side. Ralph Lauren/Polo took these guys to court and won the suit, because the logo LOOKED LIKE Polo's logo.

I would have rather been asked about the shirt, and then I could have nicely given my input on it. I own the rights to ATC and The American Thunderbike Club and its logos, and I prefer to have those shirts with the ATC logo on there and the same font face, so those shirts were a proverbial double edged sword.

You should really pick up a book on trademark infringement law before citing this stuff.

You mean like Julie, who has about 20 years in the clothing industry and 10 in the copyright infringement side, and by that I mean, as a Menswear Buyer, and being in COURT with, Nike, Addidas, Tommy Hilfiger, Calvin Klein, Ralph Lauren, and not exactly behind the same desk. I know, she or I may not sound smart, but I trust her knowledge more than anybody else, apart from a lawyer on this sort of stuff. If I see somebody wearing a shirt that says, American Thunderbike Motorcycle Club shirt, I am gonna be upset that the name is too close to mine and I'm gonna find out who the owner is. My problem also was also that I mentioned getting some hoodies made, which I am waiting on some bids, then coming home from work and finding the paraphrased quotes earlier, and with prices, what do you think I would, uh, think. If I said, I've got some crack Cocaine that will cost ten dollars to distribute, what do you think the cops would say, whether or not I had such product. : D

plus the fact that I don't think you'd come on here or Sacborg and offer a shirt in the same fashion. Although it IS easier to ask for forgiveness that permission.

BTW, Nice shirt. I got a Buell shirt from my father this xmas as well as some Buell Logo gloves. Best gift this season for me beside my buying myself the S1 Lightning.

lots of buell items on ebay.....shirts just like this one......I wonder how these guys get away with it on ebay....they are definitely using all motorcycle logos.......for profit.....REX

This guy’s wife gave him a beautiful present. One she made herself.

A Christmas gift. As in, it’s Christmas time.

Can’t you argumentative types turn it off for one day a year?

It’s a lovely shirt. But better, it’s a story of love and giving, and it made me feel good.

Anyway, I really like it and it's a great gift.

Captpete, you are right about that. My wife is at home raising kids, she don't have a work outside home. Raising kids (... and me ; )) is her work. She don't like to buy me gifts because she said it like using my money to buy me a gift. So she try hard to do find some special gifts for me and I really love this one.
