Well, I know it is a lot of time and money but like the others have said, don't let this ruin your holiday season. Harley isn't threatened by the 9000 Buell owners because we represent the very small minority (Harley owned) motorcycle buyers. Plus, the bikes that we did purchase were not the over priced under powered chromed blocks that they try to coerce us to buy. In my opinion, our best hope is to A) find a dealer that actually contains Buell knowledge, B) find a dealer that actually cares about the Buell line of motorcycles, C)find a shop that won't take your house to fix your bike and D) learn to fix your own bike (I realize you said you had your own shop but I am actually talking about people like me with absolutely no mechanical ability).
As far as out bikes being obsolete, if you have love for your bike, then it will never be obsolete. Though I guess the R and CR will be left behind as technology progresses and parts become even more scarce. I am waiting impatiently for the release of the RS as well but more so because I want to know if I will be able to afford it or the conversion kit. I'm sure I wont be able to though

I've known you long and well enough to know you CAN deal with this.

You'd be surprised at all the open Google searches I do pull up BWB threads.

Gather all your facts and go to CS like Court said.
Be straight with them and lay it out.

Another idea, get in touch with the riding school who ran the track day and get a letter stating it was a "training course to improve rider education for better safety on the road" and not directed at racing.
Out of interest how many miles since the "repair"?

i wrote a letter to montana banks...east coast something or other for harley
i hear he is a decient dude...im getting my baby back today..i should say TAKING her back today..what really bothers me is that they just might get away with it..
if i could ask one thing from you dirt bag,buell riding,freaks of nature is write harley..or banks ..or who ever..let them know they should look into this..it is criminal..
just bring it to their attention..ill take the hit...but just let them know..somethings not quite right here

I had a situation like this with a Lotus dealer when I was 18.
Their mechanic fried my wiring harness of my S1-MkII Europa, then said it was fried when I took it in.
I drove 118 miles to their shop...

DON'T SIGN a RELEASE!!! just pick up your bike if you can without signing.
If you sign the release, it IS all over.
That's the time to lawyer up.

Lawsuits are always a nightmare, especially involving racing. You can say it was a trackday, but to judges and juries you most likely will be the crazy guy. You might want to contact Erik_Buell_Racing to see if they can help you with economical parts. Their reputation for that is good, and although it's easy to be upset at H-D for the Buell shut-down, at least some leadership at H-D was smart enough to allow Erik to set that business up to help Buell racers.

P.S. - how do you get the stuff on the shelves to stay without sliding. I saw your pic and turned my shelves on their side and can't get it to work. Do you use Velcro or magnets or something or are the boxes just empty and very light?

Seemed wrong to me too . . . . I keep putting the stuff on the shelf and it won't work. It does seem wrong, but I'll bet I'm just doing something wrong.

I'm gonna try a couple more times then I have to jet off to a meeting.

Ask them what they do in other cases when their computer entries are discovered to be in error? Tell them to delete it and start over again and also that this is likely related to the prior service.

Once your labeled in the system their is no reversal. He has the right to have the safety campaign recalls.Any other recalls will be denied.By law they cant take safety campaign recalls.

If he persists to push them and harass them they will send him a bill in the mail. The bill will state that they intended to to repair his bike in good faith that he was riding it on the street. Once they found out otherwise they changed their minds.

Now the dealer has a dilemma on their hands. Harley is asking why didnt you tell us before he was riding it on th track. Now harley will say to the dealer you owe us money and you will not be paid for your labor. So now The dealer isnt getting paid for the labor and now harley is saying the dealer has to pay for the parts. If jersey continues to harass them they will send him a bill for oh... about 4000.00. No bullshit!!!

I really believe harley wants to take care of its customers but when something goes wrong and the value of the repair exceeds a certain limit they will pull the rug from ya. Jersey learned first hand.

What happened to jersey was the repair went wrong and the whole sequence of events was pretty much spot on with their standard f... your eyeballs out procedure. They knew when long time ago that he rode it offroad and they fixed it. Then when the repairs went wrong they pulled the rug.

Jersey knows what to do.

One thing that you can ask harley is if the tech working on your bike took the rotax class. They did have training classes I was told but the techs were to be paid by the harley dealers not buell or harley. So now we have harley dealerships to cheap to pay their tech to take this week course but instead hope they can fix nothing they know about.

I don't care what anyone says about harley and their techs. What it really comes down to is the dealer. If the dealer throws you under the rug your screwed!!

Good mechanics that are trained are hard to come by. Most dealers are to cheap to invest in the workers. In this case a new rotax engine was introduced and the dealers were approached with this program . How many workers were sent or attended Who knows?? Can anyone get these figures?? COURT?

Curve_carver - Years ago on my s1 the dealer was selling race modules no problem. With the CR it's their piggy back 'daytona twin tec' and dyno time or nothing. They want you to believe that they have the experience and the dyno setup tune values are some type of new discovery with each bike.

I really believe that harley dealers are nothing more than a bunch of crooks. Heck the guy that sold me my bike robbed a gas station. No joke!

What does that tell you when standards are set that low when hiring??

I just checked he is still listed in clerk of courts for robbery. lol

I used to work for a vehicle service contract company "extended warranty". Get a lawyer, in my experience we almost always caved once lawyers got involved. You can also see about getting your dealer and the VSC to go halfs on your repair. There is a decent profit margin on VSCs, and in our case our larger dealers all had good will accounts. This was for cars and RVs, so your results may vary. The lawyer shouldn't charge more than a few hundred shekels to draft the letter.
