If I win it, I've been thinking of laying the plastics out on a tarp and throwing random colors of paint all over them. Then putting them back on. Knowing my luck it will have a special graphics package I won't want to ruin.

Wonder if I could get on at EBR working Fridays and Saturdays to make an extra $20k this year? Erik, Need anything?

Actually if you look at the rules of the sweepstakes, it doesn't say anywhere that the winner would be publicly announced.

I'd put odds on it going to a person who has never owned or ridden a motorcycle.

I got an interesting lesson in how these contests work when my parents won a trip to the Super Bowl.

It'll be fun to see.

Buell " prizes" have never worked out well and seldom had the desired marketing effect.

I called him up. He definitely WANTS it, life and priorities however are apparently dictating that "he sell it in order to take care of other responsibilities." He's firm on the $17k.. we will see how long that last.

I called him up to last night he still wants $17,000 will not come down. I tolled him to look on the EBR sight and how much they were that he will never get that much out of it so he hung up on me did not even say by.

He's kind of in a fix with that. Uncle Sam will want him to pay taxes on full retail price, but he won't be able to sell it for nearly that much.

A LONG time ago (late 1980's?), a co-worker of mine won a Suzuki Samurai (mini-Jeep) in a contest shortly after those were introduced. Unfortunately about the same time he won the vehicle stories were coming out about how these things were prone to rolling over, and their retail value plummeted. Dealers were having to discount new ones heavily to sell them.

My co-worker "heard from a friend" that the IRS would only tax him on what he sold the vehicle for. He sold it for about 60% of the retail value, used his earnings to pay off a loan on his primary car, and donated most of the remainder to his church since he wanted to share his good fortune. When tax time rolled around, he wound up having to take out a loan to pay the taxes on the full value of the Samurai!

He was NOT a happy camper.

Well 8% at $20k is still only $1600, I don't know what the tax rate is where he is, but even if he sold it for $10k or $12k he would still have a fat wad of cash even after Uncle Sam takes his cut.

The value of the "prize" is "ordinary income".

If the guy is in a 28% tax bracket he's on the hook for about $5,000.

Plus state tax plus 7% self employment tax. In California ordinary income tax nets to about 50%

To be clear . . .you pay SALES TAX on something you PURCHASE with earned funds that have ALREADY been taxed.

When you get a gift . . . it is not a SALE . . it is a GIFT. . . it is INCOME (just like your paycheck) and you pay income taxes, , federal, state (and in my case NYC)

One of the downsides is that the taxable amount, in this case, would be the "total cost to put in service . . . MSRP + Freight + set-up) and you'd loose the benefit of this like talking the dealer down $4,000 and waiving the freight and set up.

The "winner" doesn't get to choose the taxable amount.

By the way . . . when I was doing, while a contractor, IMS shows and so forth, as a Customer Advocate, for Harley-Davidson . . it's the reason I never let them "give" me anything . . . but I bought some motorcycles for $1 each in an "arms length" transaction where the buyer and seller agreed on a price.

it is quite common for winners on "the price is right" to never claim their prizes once they learn how much taxes they must pay. The show is in CA so they must pay both federal and CA taxes before they can take the prizes home. If you win a car it is normal for you to owe at least $10,000 and more.

Precisely the reason . . . .(and, yes, there was a time in history where you could "gift" someone into bankruptcy) that one of the several legal elements that distinguish a GIFT is that it much be RECEIVED by the person getting it as a gift.

There are others such as it has to be INTENDED by the giver . . . and others.

Like some of the amazing areas of torts, specifically negligence, there are some hilarious, distressing and alarming cases in the books.

I once had a Professor who was asked . . . "what's the difference between negligence, ordinary negligence and gross negligence?". He scratched his head for a moment and said . . . "Do you understand the difference between a fool, a damn fool and a xxx damned fool?"

Things . . at that point. . . were clearer.

It's not as juicy a deal as it may appear.
