With BSA set for a comeback, I wonder who holds the rights to the names Lightning, Cyclone, etc.

I believe Harley Davidson still owns all the copyrights associated with Buell, but it was stated here several years ago that HD corporate lawyers had been instructed not to expend any effort protecting those copyrights.

No one does. According to the USPTO they are abandoned. I'd have to check those two, specifically, but I don't think Harley-Davidson "protected" any of them.

So let me get this straight - instead of an EBR 1190SX we could have an EBR Lightning or a Buell Lightning?

Even the folks who rebuilt Triumph from the ashes were smart enough to keep the names "Triumph" and "Bonneville" instead of naming the new bike the "Bloor 900SX".

We love you Erik and we love your tradition. I want to buy a Buell Lightning. Take your name back before Mahindra does!

Not technically. But, common law may still give HD rights to it. I don't think it'd be too terribly hard to steal it, especially if Erik were to attempt.

I checked and EBR is offering a "Black Lightning" right now so maybe I spoke too soon. Lower gears on the SX, runs 10's in the quarter

You can have whatever you want if they have been abandoned. Harley-Davidson, and I'm not so sure it wasn't Judy or that fellow she worked with . . . pretty much publicly announced. . . under the "Wandell Doctrine" that not a dime would be spent on enforcement.

In addition, these things need to be maintained. They didn't get "DEAD" just cause someone in Washington has a sense of humor.

My bet is that if you make 4 bikes you will edge ahead of LAP in manufacturing numbers . . .

Could happen . . . . but, I'd wager there isn't a mountain of interest in a 10 year old design . . .as gifted as it was . . . at the price point.

I could be wrong.
