ECMs such as the HD Super Tuner will cost the company over $12 million in fines, Worse, they will be in the WOOD STOVE business.

Is this the true retribution for screwing Buell?

The EBR 1190 is CARB compliant and needs no ECM change for the street,

Lastly, wasn't the EPA a presidential appointment and not a completed and legal bill into law?

Try this on...

The woodstove project, which Harley-Davidson will undertake in conjunction with an independent third party, will eliminate excess air pollution caused by using the illegal tuners by providing cleaner-burning stoves to designated local communities, thereby assuring better air quality in the future.

I just wonder if those stoves are loud right from the factory, or if you need to get an aftermarket pipe from Home Depot first.

H-D says for competition only. Am I missing some great bagger road racing or Triglide dirt tracking somewhere? It must be for those that trailer their bike to the burnout pit competitions!

Issue was the Harley Davidson was installing the HD Super Tuner on NEW motors.
So, the ruling was, they were selling non-CARB vehicles. That is what they were sued for.

Harley Davidson was installing the HD Super Tuner on NEW motors.

Where the heck are you getting this information? Harley-Davidson was NOT using this product on new bikes.

I'm sure some of the dealers were, and completely throwing caution to the wind with regard to a law that has been in place for years.
Keep in mind that the dealers are independently owned and operated.

Snacktoast is correct.
I should have stated the dealers were installing them on new motors.
That was the intent of my statement. Sorry for the confusion.

I do not like the ruling, and it does go against president that selling products like this is legal. It is the responsibility of the buyer to use it as it was intended.

http://www.bloomberg.com/news/articles/2016-08-18/ harley-ends-screamin-eagle-sales-after-u-s-emissio ns-suit

"Harley-Davidson Inc. will pay $15 million to end a U.S. lawsuit accusing the iconic motorcycle maker of selling performance-enhancing engine tuners the government said were illegal emission-control defeat devices."

"In a settlement announced Thursday, Harley also said it would stop selling and buy back and destroy its “Screamin’ Eagle” Pro Super Tuners. But Harley disputed the government’s claim that by selling its tuner through its dealer network, it enabled dealers and customers to tamper with motorcycles used on public roads. . . ."

"Ditlow said a provision in the settlement discourages owners from using the modifications by terminating their warranty if they do."

Interesting.
