i just wanted to share something with you guys. i had a 2008 1125r and it was in the shop all the time. it was there about 115 days out of the 23 months i had it. i was constantly taking it to longhorn hd to get the electrical system worked on. well enough was enough so i did a little research and wrote the lemon law letter to HD and sent it. its stated that they had 30days to fix my bike or i would sue. well they sent a rep to meet up with me and after 3 hours i left with nothing. no bike and no loan. they paid off my loan and kept the bike. i am so happy to walk away with no more stress.

i am letting you guys know this so if you ever have a lemon, it is possible to get rid of it. i loved that bike but i feel like i never got to ride it. this all took place last month.

I don't think I would settle for that resolution, but all that matters is that you are happy with the outcome.

Any plans for a replacement?

i guess that would be a good out come depending on how much you owe on the bike.

There's no way to tell if that was a good eal for you or not. As has been said before, it depends on how much you borrowed, how much you still owned, the residual value of the bike, the cost of any upgrades/accessories etc..

Still, if you're happy then that's the main thing...

You can call it Lemon Law. In reality they just bought the bike back from you.
It will most likely be re-sold as a used unit and never be fixed to your liking.
Glad you resolved your issue, and thanks for sharing.

Exactly. Simple buy back. Costs the company less than the airfare of the tech who came to look at it, solves your problem and is a good "win-win" solution.

:-)

Batbeyond - so they just paid off the loan, no money for you?
As long as you are happy, thats all that matters. Personally I dont think I'd be pleased with that.

It's a good solution.

If you wanted to make an issue of it . . . . You MIGHT get reimbursed for 2 months worht of payments while you were "deprived of beneficial use" ..... But most folks just want out.

If you paid full price for your '08 1125r on a 5-year, high-interest loan, it might be a fantastic deal, honestly.

+1 JD

I am guessing his loan balance might be well over the $6,000 value of the bike, so it might be an excellent "out."

it started as a lemon law due to the paper work i did and that i sent a certified letter to HD. they knew i had a case and sent their rep to deal with me personally. he got a call saying your next appointment is in texas. they offered me money, then offered an extended warranty, then when i said no they offered to pay off the loan. i still owed $6700. i bought it before the blow-out for $10,000. with the extended warranty i would still have to pay $50 for a stater that goes out every few months. if i stayed with the lemon law i would have been awarded $11,000 but that would have taken almost a year (i am guessing).

i bought a brand new 2008 Honda VFR with 0 miles. the local dealership found a lot of them in a warehouse and bought them all.

just so ya know....... the deal was HD paid half and the dealership paid off the other half and kept the bike. the buell tech at the dealership bought the bike from the dealership.

i am still waiting to hear back from that tech cuz i have small parts and the fairings for the bike to sell him.

It's an easy ....... As I said ..... And cheap "win-win" solution.

Everybody got what they wanted/needed and walked away.

Good solution.

Ya got screwed.
when I filed a Lemon Law on my '08 XB12XT, it was finally resolved when HD paid me $8900, gave me the bike, and had me sign a warranty waiver.
Smoking deal, I paid it off, (about 6000 owed), and traded it in for an '09 1125CR.
I can't complain at all. ; )
I had enough $$$ to hop up my XB12, my GF's XB9, and a few farkles for the CR...
Pretty much eall the farkles came from Erik Buell Racing, so FUHD!!!
