I did this with cars for a while during my “grey market days”. You would have to get an EPA test done in a “certified” EPA lab. Also need to bring it into DOT compliance-lighting etc.. If you are in the military there may }be easier rules.

Can't you just get a certificate of conformity from a HD dealer?

i am military
i have all the documents from the dealership
and i went to the DOT web page the only thing that they will test is the emissions system
i got the parts breakdown book from HD and from what i can tell it looks like the california spec
also have a random wire leading from the + and - terminals through the rear fairing to the left passenger foot peg looks like it might be a hook up to a trickle charger
it also has the remus revolution exhaust

What state are you trying to bring it into? Cali is the only difficult state to bring vehicles into, because they have strict emissions. i think the euro bikes have the cali can and the catalytic converter in the exhaust, you may need to change the flash to the cali flash to get it to pass emissions, but other then that i believe they are all the same.
Even if your bike doesn't have a cali can, you can get the parts for about $25.To check if you bike has one, remove the drivers seat, the cali can is a big black cylinder with two hoses coming out of it. you can probably find a cali exhaust for $100 if you look in the classifieds.

I'm getting back to the states in January from Afghanistan and i just bought a Barker's exhaust so i might be unloading a stock CALI pipe for cheap if you can wait that long. I bought the bike from Bigg's Harley Davidson in San Marcos Cali so it meets all emissions standards off the show room floor. I might also have the stock ecm for you too if the Erik Buell Racing one works like i hope

Something to think about: here in Ontario, Buells are not recognized as a brand. I don't really understand it but it seems they are recognized as valid US machines.

There's an odd legal piece on the gov't printed sales form nobody's ever seen because it only applies to Buells.

So, see if it plays out backwards. An export Buell that is still considered American may not have a foreign legal status and can be brought back easily.

I have no idea what I'm talking about, it's just a weird thing that might work for you.

@Boogiman1981 thanks the websites you sent were a big help
i found 2 places that can do the conversion how ever since no one has brought one back before i will be paying 6 to 7 thousand to get the bike converted if it was already brought to the states it would cost about 2500 on top of that i cant do the work myself anything i replace to get it to pass emissions they would replace again
