Its been several years but I actually got a payout from the Erik Buell Racing Receivership Account. Total Payout ... $99.25 .. My original claim was for diminished value and loss of warranty ...

I got mine too. To be honest I don’t remember what all I claimed but I sent them pics of my rusted out exhaust,cracked fairings, shop bills from my water pump and I don’t remember what else. The sent me a check for almost 700$. But I also purchased my RX in July of 14 so I’m sure that held more weight than the people that paid 10k for their bike.
The letter said it was 20% of my claim.
But they didn’t have to give me anything, especially because I did put in my original claim that if the company stayed open I would be happy just to be able to get parts and would drop my claim.
So I have to say they were super fair all things considered.

My original claim was for much more but they counter offered $500 last year. I accepted it .. then they ended up giving me 20% of that ... Ugh ... Guess I should have left in my original claim like you did.

I also paid full retail for the bike the month it came out ..

I feel your pain on that as well. It still hurts to see how much they go for now.
But it’s an awesome bike and I’ll ride it till the wheels fall off. Its just about paid for.

What do you think a 'comparable' $18-25K-ish retail 2014 top of the line super bike goes for today?!?
The first bike I though of:

The Duc 1199S lost 45% of its value in depreciation (low retail)

If I were you two, I'd send the pathetic checks back to EBR, aplogize for costing them exorbitant attorney fee's over frivolous B.S. and pray they use that money to continue to serve us loyal Buellers the way they have been so far, and as long as they can.

Not to discount 'real' problems where you need the product (warranty) you bought and it's not there for you. Sure, get reimbursed for your small outlay of cash.

Suck it up Mary, and realize that shit happens and Erik has bigger issues than you costing him $9,900 in attorneys fee's to write you a $99 check.

I'd rather he spent that money to start another motorcycle company. Heck, I'd probably buy that one too

I didn’t “ sue” I filed a claim for warranty issues on parts and service that should have been provided but were not. Obviously EBR agreed with me as they paid me almost 700$ If you read my post I even agreed to drop the claim if parts were available so I’m not sure where entitlement comes into play.
Perhaps you should know the facts before your immature mind spouts off falsehoods and half thought out rants.
If I spend 20 k on something I expect the manufacturer
to hold up their end of the bargain. I’m still holding mine. If I were you, thankfully I’m not, Ide keep my ignorant comments and uneducated opinions to myself and focus on why it is that
you feel the need to belittle others. Usually people that do that have no self esteem and need to put others down to validate themselves. If I were you I would stop wasting time trying to look like a hardcore biker and fix my personal issues before
blindly lashing out at others trying to look cool.

Ok then I guess I’m wrong, I should go thru life buying expensive things and just take a loss because company xyz didn’t survive. By that logic if you bought a new car for x amount and it broke down 8 months later and the manufacturer was out of business people should be fine with it?
Then even when they offer to pay for the things that weren’t supposed to break I suppose everyone should just forget about it?
I’ve owned 5 Buells and loved ever one. I also got stuck footing the bill for issues with my 1125.
If I buy something expensive your damn right I expect it to be backed up by the people that tell me it’s safe to buy their product.
I work hard for my money.
I’ll try your logic with the bank. I’ll just tell them they should let me not pay for my bike because I lost my job. I’ll see how that works out. Or perhaps I could just call EBR and tell them I need a bunch of parts but don’t want to pay for them, however they should still give them to me because I’m doing my best.
My post was made because The words you two and pathetic were used.
If someone has the chance to recoup some of the thousands they spent on replacement parts and they don’t do it. That’s on them.
But for the people that did, they shouldn’t be knocked for it. Perhaps both you guys have more than enough money. I don’t and there are many in the world in the same position.
I supported the business by actually paying retail.
I have nothing but respect and admiration for what EBR accomplished.
But that doesn’t change the fact that they offered and I accepted as well as many others. And those of us that did shouldn’t be knocked for it.

Not to mention the checks paid were paid out by the receivership, not EB personally. It's just business. The bikes weren't sold as is, they were sold with a warrantee. So EBR's receivership was in fact a breach of contract to that extent.

My opinion was more expressed toward the OP's comment of suing a defunct mfg over for "diminished value", because it's a... defunct.... mfg.... (roll eyes).

Uber-offended Jeremyn has a point. Which I agreed with, even before he lashed out to get personal and nasty to me.

I understand what your saying but you included me when you said you two sued for diminished value which I did not.
That was not my concern at all.
And in my original post I said that I did offer in my settlement to drop it if they remained open.
So I obviously wasn’t trying to just get free money or anything like that. If I didnt support the brand I would have never put that in there.
They then sent another letter saying that they were in a completely different circumstance and were in the position to honor warranty claims and all I had to do was sign a paper and submit proof. Which I did.
The very fact that EBR honored my claim for 700 proves that all my claims were valid and warranted.
So being told that I , or anyone filing claims is wrong.
Especially when EBR sent a second letter to many of us saying they were in a position to honor warranty claims, is not fair or right.
I certainly didn’t go looking for anything but the opportunity presented itself, the company said they were in a position to pay so I accepted their offer.
There has never been a sense of entitlement by any means.
Perhaps I was too harsh in my words and I apologize for that.
But when the company sends letters to owners saying they want to make things right, I can’t see how anyone is wrong for accepting that offer. At that time the company supposedly had a solid 5-10 year plan and so
There was no kicking them when they were down.

I didn't sue anybody ... When EBR went under .. I received a letter from EBR lawyers (as did many other original owners) asking if I had a claim. I submitted documentation and paperwork as requested.

All of these payments were made from the money that LAP paid to purchase EBR AFTER the closure. In no way was that money taken from any employees or owner of EBRs pocket. It also WAS NOT available to EBR to use to help them stay open longer.

In My Opinion;

Receiving the payment was just part of the distribution of a bankrupt companies assets to those that had a right to said assets. It has nothing to do with suing anybody. It has everything to do with a fair sharing of the remainder of the value to those who have a vested interest in the company. The payout was pennies on the dollar to those that received anything for what they had in good faith purchased. Being made whole did not happen. An equitable sharing of what little was left to be returned to the rightful owners of what was left. It is how bankruptcy works. This was not a wind fall from a law suit. No one really wins.
