Both were double the legal limit "Billy Lane’s BAC was returned by the FDLE crime lab reflecting a blood alcohol level of .192, while the autopsy report of Gerald Morelock later showed he had a blood level of .133"

"while attempting to pass 3 vehicles in a double yellow no passing zone along Highway A1A in Melbourne Beach."

DUI or not on either person. Passing on a double yellow is not safe. Passing two cars is really not safe. Passing three cars is stupid. Passing three cars in a Truck at night is well beyond stupid and dangerous.

They should have not dropped the other charges.

It helps to remember that criminal trials are for the benefit of the state, not the victim (civil trails are for the victim.) If one drunk driver injures another, it is entirely possible for the state to prosecute both of them.

Florida's BAC limit is 0.08 g/%. BL was a touch over double but Morelock was not.

Man you guys are harsh!

I am sure you all NEVER had a drink and drove!?...

Unfortunately he had a accident while drinking, it happens. Not saying it is right at all, but dwelling on the fact he was at "TWICE the limit"?
That IS LIKE 2-3 BEERS..Give me a freakin break.

There are people that live in a bar and drive everyday afterwards. where is that justice?

At least the guy works and promotes bikes (weather you like em or not).

2-3 beers would be what a small female non-drinker.

A known alchol drinker. Fat. Can easly hold drink 3 beers and be under the legal limit. Mind you his body had well over 45 minutes after the wreck to process the alchol and decrease the levels.

And yes. I've never drove drunk - by any standard. My job depends on a security clearance and I value my life and the lives of others.

"There are people that live in a bar and drive everyday afterwards. where is that justice? " And those are the ones that kill people then come up with some trash. "I never do this"

"At least the guy works and promotes bikes " But not in a good way. His bikes were built crappy. His lifestyle made all bike riders look bad. Now a public event like this. "promotes bikes" LOL

2-3 BEERS Are you kidding?

Males drinks = wt (lbs) X BAC X 0.33

say BL weighs 180 lbs

Drinks = 180/3 X 0.19
So 11 drinks minimum to get to a 0.19 and 1 drink an hour to maintain it.

If he'd been randomly firing a pistol and hit someone, he'd go down for manslaughter.

Why is a 5,000 pound truck any different?

Both drinking and driving and firing a pistol randomly show poor judgment.

If you're Ted Kennedy and happen to leave your date at the bottom of a river, "sucks." "Thirsty?"

I truly hope Billy Lane's no Ted Kennedy.
