She was an American icon. I may not have agreed with her on some issues but she is a giant in American history and American Jurisprudence.

I don't know a great deal about her. But, I am going to make it a point to do some reading to see if I can get a keener grasp of her views, background and philosophy.

+1, Court. I remember when "On The Basis Of Sex" came out... guess I'll have to cue that up soon. Just read a very nice piece in memoriam over on NPR's website.

I agree with Court. I disagreed with her on most issues but there is no disputing she left a huge mark on American Jurisprudence. RBG was an icon of the left.

I don't see Trump getting someone on the Court before the election but after he wins re-election I hope he puts a stone cold conservative in her place.

The senate passed on an Obama appointment because it was close to an election. If they confirm a supreme court justice before the election, it’ll be pretty hypocritical. I hope they have more class than that.

According to conservatives on Twitter (For what that’s worth), the unwritten rule is a justice won’t be replaced right before an election if the president belongs to a different party from the senate majority. Since both are republicans, the rule doesn’t apply.

Since we’re already in for what will probably be the most contentious presidential election in history, and major Democrats such as Hillary have indicated Biden shouldn’t concede the results no matter what, it seems pretty imperative we need a full 9 member Supreme Court going into the election. With only 8 members and a tied vote, any case brought before them goes back to the lower court and the lower court’s ruling stands.

Buckle your freaking seatbelts...

Hahahahahaha . . . that thought . . . half way through the prior sentence . . . . was going through my mind and there . . . as if by magic . . . there it was.

You are both clairvoyant and wise.

I ascribe to Twitter a similar level of credibility as I used to give Bill, the drunk at the corner bar. Sometimes he was right . . but rarely for any logical or conceivable reason.

Thanks for an interesting post.

First, RIP. Didnt agree with many of her opinions but certainly respect her intellect, legal knowledge and accomplishments.

That said, didn't Obama say elections have consequences. The Rs have the Presidency and a Senate majority.

Still, maybe it is smarter for the Republicans to drag it out. Use this and 2nd Amendment, 1st Amendment, Roe vs Wade to drive voter turnout.

The affect on voter turnout works both ways, probably more an advantage for the Dems as they risk losing a seat and seeing a solidly majority conservative court.

Hoot:

Untrue. It is the prerogative of the Senate whether or not to proceed on a lame duck or election year nomination, and throughout our history whenever the Senate has been controlled by the opposing party to the President, the nomination doesn't proceed. It was NOTHING new what happened to Obama's nominee. The Fake News made it seem so though, didn't they?

It is also the case that when election or lame duck Presidents are of the same party controlling the Senate, they almost always nominate and fill vacancies.

In all cases when the President and Senate were the same party, election year appointments were undertaken, and succeeded in 9 of 10 cases.

Choosing not to nominate or fill a SCOTUS vacancy would be historically unprecedented.

Rest In Peace Ruth, I almost never agreed with you.

I'm only one man. This man happens to think your vacancy needs to be filled, like... NOW.

Another conservative justice could be the one thing that saves this country in the long term.

You don’t just suddenly die of Metastatic Pancreatic cancer. She has been in Hospice care for at least a few months, refusing to resign and give time for President Trump to nominate a successor. This is NOT an example of an impartial Jurist, these are the actions of a politician.

Quoting President Obama: Elections have consequences.

Quoting (paraphrasing) Senator Cueck Shumer: Get off your collective butts, nominate and approve a Justice.

Justice Ruth Bader Ginsberg, like everyone else in Washington, has her politics. In the instant case, she threw down a gauntlet, gambled and lost her bet trying to outlast President Trump's first term. This takes nothing away from her greatness as an icon in the legal field and a pioneer in Woman's (and Men's) rights.

I expect a nomination next week with hearings to start promptly.

If Trump wins, the aging conservative justices should step down so they can be replaced by other conservatives. I hope they don’t pull a Ginsburg.

I liked the lady. Class act.

Didn't agree with her frequently, but that's true of the Court as a whole, and more than half of them nearly all the time.

Her position on cases was well written and she was capable of friendship with people she worked with and disagreed with. No snowflake or cancel monster, she.

One of the good ones. Will be missed.

Refusing to die or retire is actually a pretty honorable way to act on your convictions. It's nothing like Al Gore or Hillary refusing to accept election results, it's a lifetime appointment. She was picked to support a view on the Constitution, and generally did so.

The multiply accused rapist and confirmed sexual predator who preyed on underlings that appointed her certainly deserves prison, but that's not on her. Cornell and Harvard, her education, have become racist Marxist indoctrination centers, but in HER day they were among the best in the world for learning law. Context matters.

She will be missed, and compared to today's intolerant wretches deserves Sainthood for intelligent thought.

“The Fake News made it seem so though, didn't they?”

They may have, but I didn’t watch it. I formed my own opinion over the past year or so when it became apparent that her time on Earth was nearing its end. Whether the president and senate are the same party or whether it’s Tuesday and snowing in Idaho are not relevant.

Fully agree. She was a terrible guardian of the constitution. I don’t understand why conservatives are praising this woman’s accomplishments when the main thrust of her decisions effected destruction upon America’s founding principles.

Allow me to explain. No, that would take too long. Let me sum up.

The senate has the constitutional duty to provide advise to the executive regarding judicial appointments, and to provide consent after a potential judge is nominated. The constitution contains no references to election years as caveats to this responsibility. Every time the senate has failed to hold a vote, they are abrogating their constitutional responsibility and their oaths. So yes, they should vote on, and in my opinion confirm, Trump’s pick. However, they failed to even have a vote for Obama’s. This is hypocrisy. They, and every previous senate, should have held a vote, in accordance with the constitution.

It may not be Facebook . . . but, if you want to learn about some of the thinking behind some folks staunchly held concerns about voting rights . . . read Justice Ginsburg's Dissent.

Again . . . my view are seldom coincident with her's . . . but, she changed history and has an amazing story.
