Silence is always an option. In most states, children are not required to say anything to an administrator without a parent or guardian (or law enforcement personnel) present.

I agree that walking away might not be an option, but there are other options besides breaking the law.

I don’t think anyone disagrees that he broke the law. The question is, is it a bad law, and to what extent he should be prosecuted. This wouldn’t pass the smell test, were I a prosecutor. I would refer it to the juvenile court if I were the judge, and I would question why a non violent juvenile was brought before me as an adult.

Obama didn't quietly order the law to be ignored for the kid.

It's the imbalance of power in this case that is troubling.

The kid could be a smart alec who was being "clever" by recording a discipline matter, or been legitimately concerned that biased bureaucrats are out to get him.

Ignorant of the law, or maliciously violating it?

From a sensationalist news article, you can't tell.

If you had a helmet camera on, while police politely dealt with your minor speeding offense/rudely asked for bribes/threatened you for your apparent otherness/etc. And then prosecuted you for recording that? How do you feel now?

I'll bet most "gotcha" recordings are jerks giving cops a hard time in the "I don't have to tell you my business, am I under arrest, or free to go" scenario, but some are actual records of abusive authority.

Sbeep, sheepdogs, & wolves. Sheepdogs Must be held to strict & equal standards. They have disproportionate power, and must be watched and controlled.

School bureaucrats also have disproportionate power. Ditto responsibility. Or you get ruined lives with no recourse.

I wouldn't be surprised if Principal or Student is deserving of scorn.

Re: Union dues.

If you don't like that your Union supported Hillary, ( real example ) you can ask for that portion of your dues that went to political action. ( but not building an exclusive golf resort for Union leaders, that's sacred )

Seriously, it's been the law for years.

Of course, that ignores the hostility you get for being a jerk, causing excessive paperwork and legal fees, to get a check for $4.56 for principles.

Just like scabs can expect the same level of dedication and commitment, hours of emotionally draining arguments and being threatened, as a Union rep gives to loyal and friendly dues paying members.

You just have to ignore human nature, or get off on being despised as a leech.

This isn't a knock on unions, at all. If you were an old school gas station attendant, you are more likely to care if there's oil in the cars of the nice folk that tip, or just say thank you, than those who act entitled to your services. Folk who Yell at you to hurry up with cleaning the windows, shouldn't expect the care that kind folk deserve. But they do. And company rules say you have to give cheerful service to all.

So while I applaud the freedom principle in the Supremes decision, I see the real world effects.


Not that I don't get the angst at the union political spending.

I have told My union that I think it unwise to stick to one Party forever.

First, because as the Clinton era showed, the Dems are no longer the dominant Party, every year. It made sense for decades to back the majority in Congress, but now backing the minority , maybee, won't get the desired results.

Second, ADM, EXXON, NABISCO, all the big companies bribe both sides, just to be sure, thus my union also should hedge it's bets.

Third, the Party too long exclusively supported, ( this is bipartisan ) starts taking you for granted. In rude terms, you're the old mistress, your apartment is long paid for, your performance is expected and not very exciting. A sure thing, and worse, no increase in benefits! But that new gal? She brings fresh votes and is willing to do that kinky thing you aren't. ( just as you were sought after because the old ball and chain wouldn't Lewinsky ) You are the kept women, the sure thing, be happy with the apartment and don't expect new minks.

If you want to be wooed, you can't be the sure thing. You gotta make them work for it.

It's an insulting, but accurate metaphor.

Bribe both sides. It's the only way to stay in play.

My union leaders didn't appreciate the idea, but the mid level guys did.... But those decisions come from the top.

Listened to the radio read the newspaper article that the murderer sued about. It's about his stalking and ruining a women's life, all the time posting for her to leave him alone.

Judge ruled against murderer in suit against paper, because the article was true, and you can't sue just because you don't like what was said.

Multiple signs the murderer is nuts, apparently back to High school, and the folk at the paper actually feared he would do exactly what he is accused of, killing 5 premeditated.

No ideology reported, and it seems not to have any bearing on this case.

The newspaper considered a protection order, but decided not to bother. Not a bad call, as many women murdered by ex boyfriends have a protection order.

As near as I can tell, and please correct me, protection orders only work with noisy, not very violent ex's, where there are police without much else to do. They are sometimes used as "proof" of premeditated murder when a victim kills the attacker, by evil prosecutors.

The same reason it's unwise to have a macho sign like "Rather be judged by 12, than carried by 6" on your house if you have to shoot a home invader. Bad prosecutors will use that against you.

Btw, the local Monroe county DA has exactly that kind of reputation. Even the local Deputies warn that a Gasden flag ( don't tread on me ) is unwise because of his ideology and ruthless corruption.

We had to file a restraining order against a former neighbor who was harassing us and other neighbors. The DA and Judge warned us that restraining orders can end up pushing someone to do bad things, but we decided the best course of action was to pursue the RO and were granted it with no deliberation (story too long to go into here). Less than a month later, said perp emptied a clip into our house (bathroom wall).

Cops botched the investigation and the main evidence, his pistol, was thrown out. Multiple neighbors saw his truck exiting the neighborhood so that got him in trouble, but he plea bargained because of a different issue.

Thing is, I had to threaten a lawsuit to even get the cops to come out and investigate the shooting and to point out where the bullets entered my house, then help the cop extract them.

I have some sympathy for police in general, ( maybe not the guys you dealt with ; ) ) when it comes to ROs. Any cop will tell you domestic calls are the worst. A guy beating his wife, you stop him, she stabs you. That happens so often it's a cliche.

An RO means things have gone to heck already. And the number of times people get killed by others under a RO is way too high.

As far as the cop goes, there's no win.

As to violence as a means of defense....

Yeah. Not such a good option. It may be the last resort, and it's the way things happen in a movie, but people in movies don't go to prison for shooting the bad guy very often. Happens all the time in real life.

A lot of time in police academies is spent explaining how tv shows get it all wrong.

I can draw out a logic chain that shows the only sure way to deal with domestic violence, wife beating, is to just chop the beater's head off on the spot. Every other option has a high probability that he will become more enraged, and kill her.

I'm sure you can trace the same path to the same, bad, answer.

I don't have a good answer.

All I can do is fall back on training, which says to try and defuse the situation, and walk away, and if that doesn't work, run away, and never mind that the bad guy is doing property damage. Violence is the last resort, and that sucks.

Because I'm sure the pain you'd feel when a neighbor gets murdered by he husband, and you could have just shot him, ( and gone to prison forever ) is much like the pain you feel when a friend suicides. The world becomes a mess of If Onlys. Understandable, sucks.

Easterners know "South of The Border", & bumper stickers are everywhere. ( truck stop with over zealous advertising ) Bah! Wall Drug in S.D. not only has road signs for hundreds of miles, it has signs for Airplanes, and it's own airport.

Sure, South of The Border is a good place to get your ",gators eat tourists" shot glasses without actually going to Florida.

But Wall Drug has Jackelope shot glasses, fine turquoise jewelry, clothing, and a kid's playground that doesn't look like a horror movie set. ( then again, I've never been to South of The Border in daytime )

Anecdote. First family trip to Disney World, as an adult. Mother asked if I packed t-shirts. Uncontrollable laughter. Uncomprehending stare. Packing t-shirts to Orlando is coals to Newcastle. Every other store is a t-shirt shop. Russian Mafia money laundering! Better yet, every ride at Disney, discharges riders through...... The T-shirt shop.

The Judge In The Bundy Trial Just Spiked Prosecutors’ Plea For One Last Shot At A Conviction

A victory of sorts for patriots. Hard to call it a victory when your entire life had been completely overturned, but it's about the best you get fighting a tyrannical government. It's a true shame that people are still dealing with the aftermath of the tyranny of the BO administration and their willing conspirators in so many government agencies.
