Why must a Defense Secretary be retired from the military for 7 years?
What is the purpose of that federal requirement?
Anybody have a good answer?
A good guess?

Most likely to give some disconnect time between the new SECDEF and his former subordinates.

That requirement was waived for George Marshall.

The military is civilian controlled. It is controlled by the President and by extension by Congress. This requirement seems really silly to me. It is logical that the Sec Def have a very intimate and deep understanding of the military.

You need a waiver for this guy but any academic or lawyer that doesn't know shit about the military, military philosophy or strategies is automatically qualified for the job just because he didn't serve in the military? Give me a break.

The waiver appears to be trivial, but I've also heard that if put to the test, the law requiring the 7 years would be found unconstitutional. Constitutionally, it is solely the President's discretion who to nominate for his cabinet. The law violates that strictly executive branch prerogative.
