Another Appeals Court Rules Obama Recess Appointments Unconstitutional By Ken Klukowski May 23, 2013
Breitbart News reported on Jan. 25 that the federal appeals court in Washington, D.C. declared President Barack 0bama’s recess appointments unconstitutional. Now another federal appeals court has done so as well, all but guaranteeing the Supreme Court will take up this issue in what could become a major defeat for the president.
...In Noel Canning v. NLRB, the U.S. Court of Appeals for the D.C. Circuit held these appointments were unconstitutional several months ago. Now in NLRB v. New Vista Nursing and Rehabilitation, LLC, the U.S. Court of Appeals for the Third Circuit has done the same in a 2-1 decision.
...0bama’s appointments were therefore unconstitutional. As such, every order and decision issued by the NLRB over a period of more than a year would be invalid, carrying no force of law.
Breitbart News legal columnist Ken Klukowski is on faculty at Liberty University School of Law.
I thought Wonderful's illegal appointments to the NRLB was about as low as one could go. The Executive Branch illegally usurped the Legislative Branch which is clearly unconstitutional.
Now, every decision of the NRLB since then will either be revoked or litigated. Nice move, Wonderful.
Haven't you ProGlibs had enough yet? You are strangely and uncharacteristically silent lately.
The days in office of this Community Organizer in Chief are numbered and it will be a lot sooner than Jan. 2017.
Strassel: Conservatives Became Targets in 2008 The 0bama campaign played a big role in a liberal onslaught that far pre-dated Citizens United
By Kimberley A. Strassel, Wall Street Journal May 24, 2013
The White House insists President 0bama is "outraged" by the "inappropriate" targeting and harassment of conservative groups. If true, it's a remarkable turnaround for a man who helped pioneer those tactics.
...This history also casts light on White House claims that it was clueless about the IRS's targeting. As Huffington Post's Howard Fineman wrote this week: "With two winning presidential campaigns built on successful grassroots fundraising, with a former White House counsel (in 2010-11) who is one of the Democrats' leading experts on campaign law (Bob Bauer), with former top campaign officials having been ensconced as staffers in the White House . . . it's hard to imagine that the Obama inner circle was oblivious to the issue of what the IRS was doing in Cincinnati." More like inconceivable.
...If the country wants to get to the bottom of the IRS scandal, it must first remember the context for this abuse. That context leads to this White House.
This IRS thing aint over. In direct violation of the First Amendment and the long standing traditions of Religious freedom in this country.... THE IRS has established within the PPACA a schema of entitlements, grants, exemptions and FINES based on religion. ie Muslims will get a pass on ObamaCare against the tax, Christians will not
watch and learn wait and see
This is as close to a state sponsored religion as it gets
Trifecta discusses a family that fled Germany because of the European nation's anti-homeschooling laws. This evangelical family is now forced to comply with Nazi era educational laws that run contrary to their Christian faith. In deporting the family, Obama argued that this law, enacted under Hitler, was fair. Why is Obama defending the German educational system? Find out.
On Memorial Day weekend no less! I remember when he was first in office he failed to salute the marines when boarding marine one too. I think he had to be told to do this.
Meh. He isn't in uniform, he doesn't salute. I realize he's an honorary soldier by virtue of being the commander in chief, but he's in civilian clothes. Military officers in civilian clothing do not return salutes either. This is a non event to me.
Chain of command - he is the 'commander in chief' all of the decisions are in his wheel house from day one - you learn the chain of command. Junior always salute senior first, that includes civilian chain of command ie Secretary of Defense, Sec of Navy, and yes, even this worthless pos.
To fail to return the salute (unless under battlefield conditions, or duress - is unconsciounable - but right in par for this schlep) He does not respect the military, nor the established intelligence community.... and it will come back to him soon enough
and then the idiots will think that it is all about 'race' f'n morons.
OR does the shipping of weapons to the Jihadi by the US and Turkey, the "pink line" by Barack on chemical weapons, the bombast and confusion over WHO we support in this war, etc. belong on the "watergate" thread?
