OK, so I loaned out my car trailer last month to a guy I knew from a car club. He's borrowed it before - had it for nearly a year, actually - and when he got it this time I said (and he responded "OK") "you're only going to have it for a couple weeks this time, right? I have things I need to use it for". That was a month ago. Last week I get a summons from the City of Haledon, NJ. Coded "reason", so I had to call in. Turns out he had it illegally parked. Got that sorted with the court via phone, and started trying to get in touch with the guy. Phone calls. Emails. Text messages. All...ignored. I'm done. When can I legally report it stolen? Any advice? |

Having 'loaned' it to a 'friend' under a verbal agreement ..... You can report it stolen now. I wouldn't expect much from the legal system as far as a conviction. May help as far as locating it. Get with the rest of the car club and see if they can/will help. If you know where it is, just go get it. It is yours, after all. (Message edited by Akbuell on May 16, 2013) |

I just don't have time to fiddle with driving to jersey...grrrr. Been talking with the rest of the club. He has a history with the town for...um..."yard stuff". I just need to get him to contact me. I know if I get the township involved it'll get results...they know him by name...I just hate doing that to people even after they disrespect me like this. And I'd still have to drive to Jersey. |

Reporting it stolen might get him arrested. If your not looking to cause trouble, go get it. Its only a few hours time for what, a $1500 trailer, sounds worth it to me? Dont tell him your coming and let him sweat when he finds it missing? |

Nine hours round trip, assuming zero traffic and no issues. Nine hours I dont have right now. Nine hours I should be using to do what I need to do WITH my trailer. I'll just stop helping people when they ask. Every time I do I get screwed, so f&(k everyone. |

it would be difficult to report it as stolen, as you gave him permission to use it..i assume nothing is written down. You could go to your local police district, and tell them what happened, and me thinks, they will tell you it is a civil matter. i know that isnt much comfort, but that the legal side of it. Dont be down on humanity, due to this idiot. The world is full of good people, and you have helped me, and many individuals on this board, and im sure in all areas of your life. |

Text him and tell him you are reporting it stolen unless it is in your driveway by next monday. Then let him sort it out. I'd say you are past the need to be "polite". |

If you gave him permission to take it and he did not return it at the agreed upon time it's called "Theft after trust" and is a perfectly legitimate charge. |

I'm trying not to pull the "stolen" card...if I do that and he gets in a snit...I'm still out nine hours driving to jersey and back. But if I don't hear from him soon, I'm going to have no choice. |

Any agreement is null and void by virtue of his failing to comply to the terms of that agreement. Send him a hefty rental bill for the trailer accompanied by a threat to involve the police if the matter isn't resolved quickly. |

if you let him know the jig is up and threaten to get the cops involved he might hide it and then you'll have driven 9 hours to look for something that you prolly won't find cuz its hidden. and if you do find it you could find yourself in quite a pickle trying to explain to a cop why you are crossing statelines with a trailer that has been reported stolen. so either play nice and try to find out from him or do your research (maybe from a freind in jersy) to see if and where he still has it; then sneak in under the cover of night and steal it back or report it stolen and file an insurance claim from the comfort of your home. don't feel bad about reporting it stolen. sounds like there's alot of d-baggery on his part. |

Latest wrinkle... "I'm in Florida feeling very sick, came down for work, forgot my cell phone, laptop is dead, was going to drop your trailer on the way but got a late start...I got a bunch of tickets at home about a month ago because the township thinks I have too many cars and they towed a ton of stuff including your trailer...cost me $1800 to get everything out of impound...trailer only has about $500 worth of damage to it..." wha...wha...WHAATTTT????? A MONTH AGO??? I'll be calling Haledon Township in the morning to find out WTF is going on. And no...I still don't have my trailer. But one thing that tells me...Haledon Township already knows this guy, and apparently doesn't like him. I have a feeling I can get an officer to scout for MY property, report on location and condition, slap a boot on the so it won't move and I guess I get to drive to the "garden" state on Memorial Day Weekend. Yee. Ha. |

Call the town and make sure he really did get the trailer back! Sounds like he wrecked it, was trying to stall till he got it fixed and is trying to pass the buck to the town! |

I know the town is involved...I got a notice in the mail to appear in court (my tags, so they sent me a notice). I'll be calling them today to sic them on him. He said "it was locked to my van so they towed them both together" but hasn't specified the damage. It's a flatbed car hauler, not like a box trailer or anything. I'm more pissed at the principle of the thing now... |

I would find a cheep set of tires to take with you. $500 sounds about right for 4 tires + rims. I wish I had read this Thursday morning because I was up in Parisppany, NJ this weekend for a wedding. There is a lot of construction going on the Turnpike, so.... you don't want to hear this but count on 5 hrs each way. |

Called the courthouse. Explained what was up. "Oh..is this Kenny ----?" Was the question from the other end. She said his name but to avoid any slander charges...I'm omitting it. Let's just say the court system up there knows the guy. The nice lady gave me the name of a detective lieutenant. I left him a voicemail. We shall see... |

Well the local LEOs also know him by name. Talked to the very helpful detective and he said report it locally. Once it was in the computer he'd go grab it and keep it on the muni lot and not the impound (no fees). I really, REALLY didn't want to waste 10 hours of my weekend to go get it so I sent a final warning. "Contact me immediately and tell me what time tonight you will have it in my driveway or I'm reporting it stolen". He says he'll be here around midnight. Amazing how quickly THAT message got through cleanly. |
