The Obama Administration is now circumventing the Constitution by ignoring the ruling by US District Judge Vinson rendering ObamaCare unconstitutional. The administration has not found a judge to stay this decision so as minute, there is no Obama care law. The fact that Obama has not ceased and desisted the implementation of this unconstitutional law might make him open to impeachment. Congress must subpoena Attorney General Holder to determine why they are not upholding the law of the land: ObamaCare is unconstitutional and the whole law is null and void.

Well . . ALMOST true.

The Obama administration has NOT REQUESTED a stay.

In order to tender a request a person must present a compelling argument that a decision will be overturned on appeal.

They've no leg to stand on and are likely quite well aware of it.

I understand that the Justice Dept. is going to block the fast tracking of this case to the Supreme Court. We all know it's heading there anyway, let's get on with it. The sooner it's resolved, the sooner businesses can plan their capacity to hire new employees. To drag this out for years can only do damage to the country. I really don't understand this at all.

A Supreme Court ruling that ObamaCare is constitutional will lead to actual tyranny. Congress will then have unlimited powers under an open ended definition of the commerce clause to force the People to do its bidding. Listening to Democrats like Dick Durbin is just plain scary as they propose despotism. It is time for the House to depose these usurpers of the Constitution. It is funny how the Media is absolutely silent on this issue as if it is somehow OK that Obama refuses to uphold the law.

Is Obama more like Nixon or Mubarek? You know, the civil president who "puts the boots to the throat" and "brings a gun to a knife fight".

Welcome to 1776. Or is it the Bizarro World?

Article 155 , subsection H pg 54.
It matters not.

Shall any clause of this bill be found to be unconstitutional, it shall not impose any limitation to the implementation of the rest of the bill.

to my knowlege that is the first time the severability clause has been specifically pre-empted.

They havent read it, it has nothing to do with healthcare, and they are already planning for a 'revolution' And it makes MACDIS and SAEDA look like a prom dance.

Was the severability clause not stricken from the bill that passed?

P.S. - I've got an exemption but it would still be interesting to know.

Yes it was removed from the bill. They had it in on early drafts, but then took it out. You have to wonder about the thinking behind that. My guess is that they are hoping the Supreme Court will turn a blind eye to the unconstitutional aspect of forcing people to purchase insurance for the "greater good".

This last judge hit the nail on the head though, saying that viewing it that way give the government unlimited power.

When has a super power nation with unlimited power granted to the government ever been a force for good in the world? I find these to be very scary times.

Even in this time of near bankruptcy the Interior dept. is still taking over land by declaring it Wilderness even though it doesn't fit the requirement.

Not even talking about what they are doing with the oil drilling.

This administration is out of control.

If Barack keeps it going, they can't make it go away. They'd have to fire people and shut down offices, and that almost never happens.

You'll need a LOT more honest people in the Senate to impeach him. Not likely.

This happened before, many times. The court says don't tear down the house, and the house is gone by the time the Marshall gets there. Oops. Too bad, so sad.

Impeachment of Obama is unlikely but it is important to put him on notice that he is acting in Nixonian fashion.

If the Supreme Court ultimately renders the wrong verdict, then Obamacare can still be nibbled to death by ducks. Twenty eight states (26 + 2) are bringing suit, the House is solidly opposed, and every Democrat in the Senate is now on record for voting against repeal. In 2012, it will now be easier to oust up to 23 of these rascals from the Senate. After a while, even people with a leftist world view are going to have to admit that they are on the wrong course and realize that only Conservatism can save America. The Left leads to victimization, servitude, division, tyranny, decline, and poverty. Vonnegut wrote about that type of "equality".

Happy 100th, Ronnie. You done good and we miss you, sir. (Notice how the last issue of Time tried to equate Obama with Reagan. What a joke).

It is time to take note of those who are siding against the Constitution and vote them out. Failing to do so will have other countries writing of the history that once was the USA.
