I filed a complaint with both ebay and paypal. Both declined my request saying I recieved what was promised in the auction. I'm concidering filing a mail fraud complaint...just because I can!

That's shady. I would keep fighting that one as much as you can.

You didn't recieve what was promised because he specified a part number that was faulty and lead you to believe you were getting something else.

The battery and tray are pictured, and the description clearly states battery. The only thing it looks like is missing from the picture is the strap and nuts and bolts. What did you get?

Did you try to resolve the problem with the seller? Judging by their prior feedback, I doubt that they intentionally tried to screw you.

You still have not said what you actually got.

If you knew what was supposed to be in that kit, and did not see it in the photo, why didn't you ask about it?

always pay with a credit card through paypal. That allows other options-- such as stop payments.

BUELL S1 S1T S2 S3 REPLACMENT BATTERY KIT NEW LIGHTNING

states that it is the KIT in writing and lists the MFG part number, then also states it comes with a used battery. If you got anything less then the as stated kit with no description of missing parts, then you do have a claim. It will be more in how you state your claim to Ebay and paypal as to how they back you.

Lake_bueller, have you noticed the questions here?

The problem is that it is up to you and the seller to work out the details and come to an agreement. File a dispute and see what happens. If you are right and the seller is honest, he may make it right.

If the seller stonewalls you and says the deal was right, eBay does not have anyone that will look at the deal and tell the seller (or the buyer) that they are right or wrong.

There is some kind of arbitration process, someone has to pay for it, the seller does not have to use it if he does not want to.

eBay got it's listing and selling fees and does not give a damn about the buyer. The seller has the money and wants to keep it.

The processes that look like they should give the buyer some course of recovery or justice just don't seem to work. They have never worked for me or anyone else I have ever heard of.

You can't be too careful in making sure that you know what you're going to get before you buy on eBay.

Sorry guys...been away from the computer.

I recieved the battery and bracket. What really pisses me off is that I SPECIFICALLY asked the seller if the strap was included because it wasn't pictured. I recieved an email stating that it was the complete kit. I even sent him the link to the Buell site for reference. What I received is the battery and bracket only.

I tried settling with the seller. All I asked for was a refund plus return shipping. They flat out refused to talk.

Paypal has denied my claim. Ebay is telling me to take up my complaint with Paypal.

Because it was sent UPS, I can't claim any type of mail fraud.

I guess I just paid $66 for a battery that I don't need.

BTW...I have since left negative feedback for the seller. Maybe that will get their attention!

Well, what you have there is your basic dishonest crook seller on eBay. He'll probably leave you a negative feedback as pure retaliation and you'll be punished again for having bought from a crook.

eBay has a rule against retaliatory feedback too but they don't ever enforce that rule. The only rules that get enforced are the ones that result in them getting to keep the money they already have.

You have my sympathy.

That should seal your case. The seller clearly advertised the kit with part number and now told you it was a complete kit. The bad picture doesn't get him off the hook- he owes you.

However, I know little of ebay, so I have no idea how you can go about getting a refund. It seems that if you could present those key points (part number, "new" claim, and his email stating complete kit) to the proper person you should be able to resolve the issue. The buyer looks big enough that they might even have a store you can visit.

Yeah, and good luck with that. Next time, if you're not absolutely positive and you don't have $60 to away, don't bid.

I'm still new with Ebay, but as I understand it, if you send an email not through Ebay, then it doesn't count at all as they don't have a record of it on there server. As it could have come from anybody/anywhere. Not sure if this is the case in you case, but hope that helps?

Bottom Line - I have been screwed by Ebay numerous times - hence I no longer participate nor use PayPal. 'nough said.
