Years ago.. This happened in VA. I was in the courtroom on another matter and witnessed it. This is the only time I know of that a court proceeding went like this.

The case was pretty straight forward; cager playing chicken with biker. Strikes bike and sends rider over hood and into windshield smashing same. Rider, spills off onto the road and as he's standing up cage man starts screaming about the damage done to his car! (Never mind that he could have killed the biker.)

Biker stands up as irate cager comes to get in his face about his 'crashing' the mans car. Biker pulls off helmet and clocks cager with same. Both ended up in the hospital, the cager with a broken nose and missing teeth. The cager for bruises, cuts and other impact type injuries.

The biker is now being charged with assault and battery. The judge hears the opening statements and declares his intentions. He considers the motorcyclist well within his rights as he was defending himself against an attempted homicide and therefore used much restraint in his defense of self. The judge orders the cager to serve 120 days for assault with a deadly weapon and pay ALL fees, fines, medical and repair costs etc.. The the judge questions the DA as to his mental process in bringing this case before him, in this manner. If the cager wishes to continue to pursue the matter, he will continue to hear the case, however, he will consider any attempts to negate the matter of the attack and subsequent response to be contempt of court and assign punishment accordingly.

Case closed.

Two hours later, during the lunch break I saw the judge, he was pulling on a lid and swinging a leg over a Beemer. The last I heard, His Honor had retired that year. Too bad, I wish I could have seen more of his kind on the bench.
