I have a 2004 XB12S, I have read that there were software updates since than that improve things such as throttle response and cold starts.
So would I see a Improvement by installing a newer ECM from say a 06 12S?

Doubtful that you'd see improvements in those areas. The 06 map is the same as the 04 map, but I think there are some corner case algorithm improvements. I don't know that those improvements will affect throttle response or cold start, however.

all year XB12S ECMs are interchangeable right? even the 07s?

Yes and no.
The 07 definitely has a subtley different map in it, and carries a different config ID than an 06. The 06 carries a different config ID than an 04/05, but 04 and 05's are identical. The map values are the same in 04, 05 and 06.

But if you put an 07 ECM in an 04 bike, or vice versa, both would run OK, but not perfect.
