Sammie,

I'm no insurance expert, but I can say start a file with each and every bill and EOB (explanation of benefits) you receive. Match them up and staple them together so you can keep track of what's been paid, denied for lack of documentation, etc. I know you have a lot going on, but do this at least weekly so it doesn't become a monumental task. You will once again end up doing someone else's job because something was overlooked and now is sitting in your mail box as an unpaid bill.

On another note of insurance, does Nick have disability insurance either through work or privately? Start that ball rolling if applicable. If no policy, call your local Department of Social Services (Adult Services) and see what they can tell you about short term disability in your state. Never hurts to ask.

If FL is like NC in terms of being a no fault state. Then they have to prove that Nick had a roll in the accident. From the sounds of what we read before, he could not have avoided this or he would have. I don't know the details of the accident, but talk to the reporting officer and get a copy of the police report. Was the driver of the car issued a citation? If so, then they must have found her at fault. Were there any witnesses that gave statements? Have they taken any statements from Nick? They may have to wait until he's off pain meds, but at some time they have to talk to him and see what he remembers.

I hope that each day gets easier for you and Nick. It's a long road, but you've got lots of support on this board. Do you have local support? Wish we were closer to offer more hands on help.

Take care of yourself and advocate for what Nick needs to improve his health status and get him to the Special Care Facility.

I've been hanging back and not saying anything, because I don't know what to say. I've never even met you or Nick, but I consider the two of you to be my friends. You two were willing to open your home to me and others just because we all are Buell enthusiasts. That's an act of incredible generosity and trust. You two should be commended.
I can't give any medical advice, but I cannot emphasize strongly enough that you GET A LAWYER!. Get a vicious barracuda of a lawyer. The Insurance companies involved have no scruples and will do whatever it takes to not pay even when they are obligated to. They don't care if your lives are ruined because they won't honor their obligations. Their only priority is to take in as much money as possible, and to pay out as little as possible. The Insurance industry has the morals of a pack of hyenas. Get the best lawyer you can, and let him go for their throats.
I'm not a very religious person, but I've been praying for the two of you. I really hope that Nick recovers quickly.
I hope to be arriving on the afternoon/evening of March 5 (Sunday), and I'll be camping at the KOA in Deland. I would like to visit Nick during the week, if he's up for it. I am willing to help out around the house in whatever way I can; however, I warn you that when I paint, I wear more on me than I get on what I'm painting (my wallpapering skills are on a par with the 3 Stooges). I usually can hit a nail with a shovel, though.
If there's anything you want from the Northeast, just let me know. If it won't fit in my saddlebags, I can ship it.

Sammie find out if the other driver(CAGE) has a cell phone ??? If so, a lawyer will be able to get phone records "AND" if that "CELL PHONE WAS IN USE AT THE TIME OF THE ACCIDENT" this person is in a lot more trouble ...

Good grief! I have been away from BadWeb for a while, and I come back to this? Sammie & Nick, take it from one who has been there-done that (with a broken back)the road is long, with many a winding turn, but it will eventually lead to a pleasant destination. The technology behind the ortho work has made great strides, and he'll heal before you know it. The mental aspect will take a little longer, but knowing that the accident wasn't Nick's fault will help as well.

I'm going to be over in Lakeland during Bike Week, and was planning on heading over your way early Friday afternoon to see what I can do to help. (I may sleep with the cats, if you don't mind; I have a couple myself...) I can also cook, if that would be a help to everyone?
Stay on the Docs and Nurses, and good luck with the special needs home.

i spoke with sammie today....they wanted to put nick in a chair for awhile...musta been been pretty rough for him. she told me he wasn't real receptive to it....she said she really needs to be with him for the next few days round the clock....i did have the opportunity to meet sammie in person i stopped by their house to check on her.she's a friggin trooper man. and now i have elwood moody runnin around my house...part shepard part pit...he's a hoot. i'll post if i have more news.

I spoke with Nick yesterday. He sounded great, not even like he's going through what he is!!! A trooper for sure. Sammie was right, he doesn't like NASCAR so we shared that. Funniest part of the conversation was when the nurse came in to give him more morphine. He said I may lose him due to the meds so we hurried with goodbyes and he was sleeping almost before we hung up. I said good bye by telling him to have a nice nap, and he was out. LOL!

Anywho, Sammie my cell is 928-210-4518. I know it can be lonely in the hospital, been there, so tell him he can call me anytime just to chat if he likes...

Hey Blake....Did you ever decide which Tickets you were buying?...I'm trying to find from those whom have been there where the best photography spots are,and thusly which tickets I should buy.The infield sounds popular but sometimes you cant get good angles through the fences.I plan on seeing the Thursday races and Supercross Friday.The Supercrosses usually start at 7:00 and main is around 9:00-10:00.I'm coming in Wed evening and have a room between Orlando and Deltona so shouldn't be more than 30 minutes from track.Think I should wait and buy when I get there?What are the Masses doing?

If I may offer a suggestion about tickets, if someone is unsure about where to watch the races from; I'd try the infield on Thursday for the Sortastock and Superspurt races. Then decide if you like the view from there. If not, then try the grandstands along the front straightaway outside the first turn. My experience has been that you can get a lot closer to the track and the bikes in the infield, but you see only a small portion of the race. In the grandstands, you see most of the track, but you're pretty removed from the bikes. Some people prefer to be closer to the bikes, some prefer to see more of the race.

nick just called me and he sounds great...looks like they will be moving him tomorrow..somewhere in daytona he said. i think he just called to make sure i'm gonna give his dog back!!

looks like they have his meds straight...and he said he feels pretty good considering....i told him he's come along way in a week. it was good news so i thought i would pass it along.

My wife and "i" went to see Nick today ...

Sammie was there overseeing Nick ...

Sammie said Nick would be moved to Daytona for REHAB today or tomorrow ???

Nick looked good and is positive even after all that has happened to him ...

Told Sammie that Nick will have plenty of visitors during DAYTONA WEEK !!!

Sammie will let us know his new location !!!

I just returned from the hospital. Room 819 was vacant!! I questioned some nurses who are understandably close mouthed but, Nick has been moved to a rehab facility in Daytona (they think Daytona).

I am sure Sammie will chime in with an update soon.

Hello Everyone
I am sorry to hear of your friend Nick's accident I hope all goes well for him. I am in Michigan and am coming down to Daytona on 3/10 I hope to be in Daytona on Friday. If there is anything I could do to help please let me know.
(I can't cook)! I plan to truck my bike until it get's warm then ride to Daytona.I would like to see as much of the racing as possible and meet up with the buell group for some rides. Any information is appreciated. I have the only BUELL in northern Michigan that I know of so it would be nice to ride with some BUELL fans.

Sorry I couldn't tell you all that Nick was moved before you made a wasted trip. The truth is that we only found out that the transfer was actually happening today, 20 minutes before the ambulance arrived.
It seems Murphy's law is riding right on our butts. The "only" place that would take our insurance and had an open bed, according to the social services woman at the hospital, is an utter and complete dive!! It's nothing but a very run down old people's nursing home!
I can't believe i had to leave him there tonight!!! It's horrible... dirty, totally @!!*ed up nurses... when we got there the place smelled like PineSol I am so allergic it closes my throat almost instantly. they were putting Nick in a room where they were stripping the floors with whatever it was that smelled that way. We were gagging and holding our breath. I told the nurse NO WAY! she found another room...I was and still am freaking out! There were 5 of us to move Nick from the gurney to the bed. there were two nurses from this terrible place on the receiving side (the bed) the two ambulance drivers wear on the other side(gurney side) and I took Nicks legs. We all had our corners of the sheet that was under him, the driver did the count and over he started going..the stupid nurse that had Nicks upper body dropped him half way over!!!!!!!!!! I thought I'd fall out right there. we got him settled and I said right out loud that Nick would only be staying this night. I was taking him out even if he came home...another ditz came in..the nurse that dropped him slipped away...the ditz says you should give us a try, we really are one of the best facilities... I just stared at her and said something like..weren't you there? That other nurse dropped him.. she says..well, she tried...he's a big man, she tried. I can hardly believe any of this is true... of course Nick's back and ribs were hurt, jarred, twisted. and now this simple minded nurse says he can't have pain meds because they don't have the same milligram dose as he was taking, she has to call a doctor. This ditz goes and gets the pills, oxycodone at a higher dose and gives them to Nick then says I give them pain pills then I call the doctor and "tell" them what I did. Ok, so it wasn't a bad thing for Nick and wouldn't/won't hurt him...but think about what she said...
I have been collecting information so I can make some calls tomorrow and get him out of there. One of the guys Nick works with will go up there and stay with him so he's not alone.
I just spoke with Nick.. he's got my cell phone, he said he was alright, but he was informed basically that the fan they brought him would have to work with the open windows because though they have AC, they don't use it.
I can't write anymore...I can't think...when I know more..I'll let you guys know.

Sammie - i called the direct line, the nurse station, your cell, and Nick's cell today....and was getting worried that i couldnt find you or Nick anywhere. its GOOD news that he's in rehab. work on getting him either better care there, or better care elsewhere. the Buell angels will be descending on Daytona in about a week, so hang tough til then!

Nick is NOT in rehab. This is not the place he needs to be nor should be. This is an old folks nursing home of which I just read information online about the abuse reported there. I'm having one of Nick's friends/co-worker, Jay, stay with him today and I just called him to ask him to feed Nick today. This place was reported on their food. I can't believe this! I have almost no voice and have left messages for someone about getting him into a skilled nursing facility. Nick's boss Joe called me this AM and told me about it. All I get is voice mail so far. UGH! I'll keep you all up dated.
Thanks again for your care and concern.
Can't wait for you all to start arriving!
All I could think last night when I was realizing I had to leave Nick at that place is that this wouldn't be happening if I had the lot of you there with us.

Sammie,

Best of luck finding a suitable facility for Nick. You have to follow your gut some days and sounds like you had more than your gut telling you this was not the right place for Nick to be.

Glad you have people around to help you while you work on this next move. From reading posts from those who have met/seen you and Nick say that you are doing a tremendous job holding it all together and being a wonderful advocate for Nick and his care.

We will continue to pray for Nick's recovery and your strength to help him get home soon.
