I got a ticket for a red windshield on my 07 Buell xb12r. I thought he was getting me for the exhaust which is a D&D. Nope just my red windshield. Many in San Diego have gotten this B.S. ticket. This is info to help you beat it. This info comes from the owner of American sport bike.

IF you had the OEM windscreen on your motorcycle, the cop that wrote the ticket is in error and you will win this case. The applicable laws specifically use the word AFTERMARKET in the law. The OEM screen is NOT covered by the law, and it is legal to run. I highly recommend to all Buell owners with Amber, Blue, or Red OEM screens that came on their bike that they carry a copy of this law with them. The word “BUELL” is molded right into the OEM screen. However, if you have fitted an aftermarket ZeroGravity blue, red or amber screen to your motorcycle, then the ticket is still valid. It’s a stupid law.

This is cut and pasted right from the California Vehicle Code. Look at your ticket. The cop will usually write the applicable vehicle code section if he knows it. If he wrote this code number, he is wrong. If he wrote a different one, look it up. But I’d bet the word “aftermarket” is there if there was a different code. I just searched the Cali vehicle code and can’t find anything that would make the OEM red screen illegal.

Safety Glazing Material

26701. (a) No person shall sell, offer for sale, or operate any motor vehicle, except a motorcycle, manufactured after January 1, 1936, unless it is equipped with safety glazing material wherever glazing materials are used in interior partitions, doors, windows, windshields, auxiliary wind deflectors or openings in the roof.

(b) No person shall sell or offer for sale any camper manufactured after January 1, 1968, nor shall any person operate a motor vehicle registered in this state which is equipped with that camper, unless the camper is equipped with safety glazing materials wherever glazing materials are used in outside windows and doors, interior partitions, and openings in the roof.

(c) No person shall operate a motorcycle manufactured after January 1, 1969, equipped with a windshield containing glazing material unless it is safety glazing material.

(d) No person shall sell, offer for sale, or operate any motor vehicle equipped with red, blue, or amber translucent aftermarket material in any partitions, windows, windshields, or wind deflectors.

(e) No person shall sell, offer for sale, or operate any trailer coach manufactured after January 1, 1977, that is capable of being towed with a fifth-wheel device unless the trailer coach is equipped with safety glazing materials wherever glazing materials are used in windows or doors, interior partitions, and openings in the roof.

Win, Lose or Draw, the cops don't like seeing any luminous color facing forward other than clear or yellow.
So, you might get another ticket, for same, from the same cop...

Well, thats just stupid.. what a waste. Make it a jury trial and spread the waste of time to a majority. And some how embarrass the police officer who issued the ticket
