Any of you guys read the news? The music industry just slammed some woman with an $80,000 a song fine for uploading music she purchased. Even though the copies she bought were her's, they still belongs to someone else. Same with the service manuals. Just because you buy one from Buell doesn't mean you can go home, photocopy it and hotlink it for your friends to download. It's still illegal, and you can be prosecuted for it.

Intellectual property is as real as physical property.

Friend of mine was a born again bank robber, you want him helping you out with cash? He prayed before every robbery so you know the cash is blessed.

It's stolen money, after that, take it or don't. But don't pretend that, somehow, because you need it, it's not wrong.

(BTW, in his third stint, he met a solid pastor who was able to help him see the error of his ways. He now visits schools and talks to kids about the idiocy of stealing.)

Well stated on all counts Mr. Collier.

A agree 100%.

SRY couldnt help it...notice it says "a agree 100%" not "I agree 100%"

Not being a jerk just being honest that seems to be a word many like to throw around to make them think they are better......

Did you really suspend "Stevenc150 " account? If so is it like permanent or like a week long suspension like what you got in elementary school for fighting?....

offering to provide?? He just suggested a link that had it. You don't have to go download it. Court's profile says he stole gas one time. Are you going to suspend him too because thats not very honest or ethical.

If you need a manual, just go buy the manual at your nearest Buell dealership, or from one of the provided sponsors on this forum. This thread should be long done by now.

The guy who's account was just suspended for offering to provide illegal copies of copyrighted merchandise.

I agree it should be bought and I'm not trying to piss gas on this fire but, if I buy the book, decided to photo copy it and GIVE that copy to a friend, this is considered pirating?

Let me turn the subject.

I would dearly love to be able to find/buy a legal pdf copy of the manual and parts book.

I envision a usb flash with Buell logo on it that is part of the key. The rest of the memory could carry some basic medical and insurance info.

When I work on my bike, i like the book handy. When I'm on the road, I like the flash drive with the pdf.

Finding competent mechanics at dealers seems to be a challenge for many posters. Finding good mechanics who are familiar with Buells is a challenge. But, lost on the road, you can plug that drive in and the mechanic can review what needs to be done from a factory manual.

" email blake saying I was wrong"

That is a lie. See the entire email correspondence below.

Truth matters, and I've made a decision to simply not put up with the selfish jerks of the world any more. My free time is just way to valuable.

ISP will be contacted. Account will likely be suspended for violation of terms of use due to behavior here and via email.

""""BadWeB despises selfish d!icks. If you want to enjoy this site, don't be one. I think we may even add a new statement to our terms of use prohibiting the use of the site by any "selfish d!icks". """"

I hope its just maintanence and not just screwing people over because they are not lemmings. This is very ignorant if this is the case.

I dunno if it is properly characterized as "pirating" or not. I do know that doing what you describe is absolutely without doubt unethical and illegal.

Yes.

That's a solid, not a qualified, yes.

For a basic understanding of the concepts involved . . try the same thing with a $20 bill and get back to us.

A bit different laws but basically the same principle.

If you are still lost try THIS.

The basics are the Intellectual Property laws grant EXCLUSIVE (that's the you can't buy it and copy it part) to encourage folks to do things . . . like well, spend hundreds of thousands of dollars taking apart 2 perfectly good motorcycles, photographing the process and putting it in a book for owners.

I have a fairly comprehensive library on various law and product liability issues, particularly motorcycle design legal issues.. If you are interested let me know and I'll keep you in reading for a long time.

Actually, there are a very small number of exclusions to copyright laws and copying a page may be exempt from that. It's a small excerpt of the work, educational and this site always encourages the purchase of the actual work. So, similar to the exemption that allows reviews and samples, the reader will appreciate and buy the original.

Copying a large piece, or the whole, is obviously a violation.

I'm not a lawyer, hoping to move that way, but not yet. It's still your site and your call.

Actually, and I'll have to check, but I don't think there is such a "de minimus" exclusion. I think there is simply a lower threshold at which folks may be less likely to pursue.

Intellectual Property laws however are a strange area of law. Holders, who are the beneficiary of such protections, must defend from ALL violations.

For an example of this, you can go back and read some of the accounts of Harley-Davidson "picking on" small mom and pop shops.

Intellectual Property laws require violations, if one wants to prevent something from becoming de facto public domain, all violations to be pursued.

However . . as a practical matter . . there are limits to where large companies are willing and able to deploy resources.

The one that continues to interest me is the ECM. I'm not real keen on the technical details but know that it's not rocket science to tell if someone has modified the stock ECM mapping.

It would be a no brainer that any alteration, regardless of what it was, would relieve the manufacturer of any obligation to perform warranty repairs to the motor.

I would love a digital copy of the shop manual just so I could print out the parts I need and prevent my hard copy from becoming an unreadable grease smear.

But.. For the life of me, I can't figure out how it could be done in a way that would prevent piracy.

They need to offer a laminated manual.
After you're done you could just wipe the pages clean.

Court

our discussion is here: http://www.copyright.gov/title17/92chap1.html#107

I'm suggesting that a page or two, certainly not much more than that, along with the strong promotion of buying a copy, would be legit. This website has always promoted buying a copy.

Again, you know enough to check that out with specialist lawyers.

And, oh yeah, use of ECMspy would relieve the manufacturer from any obligation to, not only, the motor but the electrical and mechanical as well. The ECMspy website states this as well as insurance and other vehicle challenges.

Excellent reference.

quote:

In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include —

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

In each and every case that has occurred on Badweb the intent was to avoid the costs associated with purchasing the genuine article.

This, it appears, would violate at least items (1) and (4) above.

Nice summary.

Wow, I guess I missed quite the show. First, this is supposed to be a forum for information, fun, exchange of ideas and pics, etc. I really don't think it is a place for rudeness and internet/keyboard loudmouth tough guys. I am all for banning any person like that. I hate trash talking unless its all in good-spirited fun.
Its better to let everyone think you are a fool, than to open your mouth and prove it.
As for the manual, I bought mine a month ago. I can understand lending it to a friend to help fix his bike, but for $60, why would you not buy your own. Very cheap and reasonable.

If we're talking about the whole book, I'm in total agreement. It would even be a violation to copy the book and give your buddy the book and keep the copy.

However, I would argue 3) to allow a page or two for 1) nonprofit educational and 4) to show the value of actually buying the manual.

But this would be the extent of my argument. We've both acknowledged our limitations in this area. Who knows what a court might decide. Buell will certainly have better lawyers than me or the site owner.

Again it comes back to house rules, doesn't it?
