Dear Bad Weather Bikers BBS members,

First off, I want to thank the many of you that have supported my business (Racing Performance Services) www.roadracinghelp.com. You will find that I have dedicated a tremendous amount of time providing free technical information so that many of you may have an opportunity to get more advanced information that is easily accessible.

While browsing through my log file of referring threads, I came across this thread http://www.badweatherbikers.com/buell/messages/32777/39924.html?1068386664 in which Robert Hansen posts an altered scanned-in image of copyrighted material from my website.

What concerns me is that all copyright labels have been purposely removed as well as identifying labels of content origin. Gentlemen, I and others in this industry spend a tremendous amount of time trying to be pro-active participants in this industry. I don't appreciate it. By taking my material and selectively presenting it, I lose a tremendous amount of value that damages my business and the efforts I support.

The document (Suspension solution guide) is part of my course material. I provide free access to this information on the web. Quite honestly, I provide it for "free" to drive traffic to my website and help raise money for the Road Racing World Action Fund. Over the last two and half years, I have donated over $3000.00 to this fund so that racers may have better safety.

I ask that should any of you want to use my material, please use a link (www.roadracinghelp.com). I have no problem if you want to scan some of my material in as long as it has my copyright notice/name on it. I prefer you using a hyperlink though.

BTW, you should find the November Tech Article very informative.

Agreed Marcus... its wrong to repost the original image without a link or attribution. Especially altered.

If you follow the link and look at the thread though, unless I am missing something, it is not only impossible to read the copyright notice, it is impossible to read ANYTHING. The image is unusable as anything but a teaser.

And two posts lower, within about 1 hour, somebody else posted a direct link to your site that refers to the original image you have posted.

So if your complaint is about an altered repost of your original content, I am right there with you, and glad somebody posted a link to the original site within an hour of the offending repost. We corrected the situation before you even knew you had been infringed, and not a single person had any useful access to the infringing content.

But if your complaint is about posting a direct link to a jpeg hosted on your site (this class of issues is frequently called "deep linking" ), then I have to respectfully disagree. When you published it on a website, then you published it on a website...

If you don't want deep linking, there are (moderately expensive) technological measures you can take to prevent it. I can help you if you need it. But the moment you do it, you will watch the amount of traffic hitting your site dropping like a rock.

If your complaint is that the link was direct to a jpeg image, and therefore did not have information on navigating the rest of your site, then you oughta rescan that jpeg and include an URL in there so people can type it into their browser and see the rest of your site if they want to see more. Though most web users already know to manually tweak the supplied URL for the jpeg or do a google search to easily find your content if they were so interested, even as things already stand.

So though I don't speak for everyone on the site, I will say welcome and accept our apologies for reposting an altered image of your original content without attribution and explanation. A repost of the original image with an attribution would have been more of a grey area... but a deep link that works and goes to your site and your server and your image is something that is squarely in the "fair use" catagory of the world wide web.

Hey Guys,

I put the information out there so that you can use it, I just want intellectual property acknowldegement. I appreciate any linking to my site that drives traffic. BTW, if you want a "hard copy" of the material, it is for sale and about $15.00 of the $20.00 goes to the air fence fund. The information on the suspension solution sheet was the basis for RPS customers winning over 100 races and 25 championships this year in CMRA, WERA, CCS, and MRA competition.


Enjoyed browsing your site and look forward to reading more. I will be sponsoring Mark Godfrey this year and I think we can really drop some second's off his lap times. I am sure he will keep you guys posted. From what I can tell, all short comings from the motor aside, the Buell handles great.

That probably spawned the ensuing attention. I frown on deep linking as it can drain the bandwidth of one site for the benefit of another.

Thanks for advising us of your concerns, if I had noticed the infringement I would have addressed it. Too much work lately has limited my time on the board here. No matter the reason, it sure is good to have to stick your head in here and say hello. Most Buell riders are interested in suspension setup and with the new XB Buells being fairly sensitive to changes in geometry and damping, your knowledge and guidance is very much appreciated.

Hope to see you again at OHR on a practice day not to far off. Mark Godfrey (XB9R racer) can't say enough about the improvements you've made to his suspension. I need the same help with my M2. :)

I see you mentioned my name in your post. I have visited your site and I have seen your "suspension solution guide". The version I had posted was from another site, It did not give or have any reference to you or your site other than saying "I found this on another site". I posted here as it appeared on said site. The only alteration I made was size. Here is the link to said site.

Man I cant believe this, I stay away from the board for a day and the next thing I know my names all over it!!

For those of you who don’t know Marcus McBain or his company Racing Performance Services, let me share a little with you. Much of the progress I have made as a racer over the last 2 years I can attribute directly to Marcus. I have received fee advice, free on-track tuition and on occasions a free lunch!. Marcus does not do this only for me, but many, many others. I know the issue of his intellectual property he holds very dearly. He takes a lot of time to produce quality materials. Much of the materials he presents freely on his web site can not be found anywhere else and seeks little or no reward for himself for these documents. Go look at www.roadracingworld.com and check the Air Fence Fund. You will see his personal donations exceed those of many (Well known) corporations. Just leave his copyright marks alone!!

As Marcus has stated in his later post, he has agreed to sponsor my racing efforts in 2004. This is not a $10 if you win type of deal. No, this is a contracted deal that will enable me to run the very best suspension available on my XB9, with Marcus adsorbing a considerable chunk of the finances. Also he will be there at track for every race. A man dedicated to the sport.
