ECMSpy works fine with the '08 and I've been pulling tunes and datalogging things without any problems. I think there could be an issue with older '08 ECMs, but mine doesn't seem to be an issue. Try to datalog the bike while riding it with your laptop. You want to capture the bike in the act of stumbling and rumbling down low. Should be able to figure out whether it needs to be leaned out or richened up in certain areas of the map.
