So my 08 had it's second dead battery, any guesses what causes this? Someone suggested the instrument cluster.

It could be the IC. Or a few other things. lets start with an easy one or two.

I have the same bike, I've never had any issues with drain or dead batteries and I have almost 10k on it.

How far do you drive it daily? Do you use a trickle charge (battery maintainer) on it?

I got lucky because I thought all Buells came with trickle charges as the two I bought from my local dealer came installed on them. I didn't find out for a couple of months that the trickle charger was a dealer installed item that you get free with a bike purchase.

I always plug mine in through the winter and at least 2-3 times a week. Takes 3 seconds to plug/unplug.

could also be VR that's what killed 2 batteries on my 08 had the ic replaced too but that was due to the lfl being weird

Which s/w revision is your IC at? The "early" ones were the ons that had "parasitic draw" - her's an extract from a previous post:

The tech tip addresses IC produced between Oct 29, 2007 and May 16, 2008. There is a software issue that can keep the security system "awake." Parasitic draw during key-off situations may require IC replacement. Software versions affected are pre 5.1.1 (ie 4.1, 4.2, etc.). 5.1.1. should not be replaced. Software version can be found on the rear of the IC on early models or vis ODIS on later models.

I also have an '08 that has the IC upgrade. I installed the accessory plug and was using a radar detector. I was having to charge my battery after about 250 miles of mostly highway riding. I stopped using my radar detector and have not had to charge the battery since.

Nope I don't have a trickle charger- I jump started the bike and it seemed to recharge itself

Find out what instrument cluster firmware and what ECM program you have, it sounds like you got an old one.

One way to avoid the parasitic draw on early clusters is to follow this shutdown procedure:
- Shut down motor using the kill switch
- Then switch the key off

It was just at the dealer for service and they said thE computer was up to date as per the Von, (idk any other way to check) as for the ic it is old because it doesn't display voltage or what gear the bike is in, not sure how old though

You mean the VIN? The tells you nothing about the ECM programming. The only way to check is to use a ECMspy cable and check with your computer or have the dealer check using their computer by plugging it in.

No 08 came with a voltmeter or gear indicator, but that does not mean your cluster is old. Check the cluster version by going into diagnostic mode on the bike and scrolling through the menus.

Froggy, you can not tell the software version in the early ICs except to look at the label on the back.

Measure the current draw with the ignition off. Place an amp meter between the + post of the battery and all the leads that attach to the + post. I think the spec is 3 mA max. Someone who has a electrical manual handy can confirm.
