Ok guys I finally got my bike to my house and was able to take some pics of the damage. Sorry they aren't the best pics but the bike is sitting in a bad place and since my spleen is busted up I can't lift anything so can't move it without help. Here goes:

The crash busted the fairing and fairing stay off the bike. Was only being held on by a few wires. So here is a pic without the fairing.

Frame damage = 99% chance of it being totaled, regardless of any other damage. This is due to liability purposes.

I'd guess the chances of anyone getting enough parts to fix it at this point are slim to none.

Duggram: I had a lacerated spleen. Spent 1 day in ICU and 3 in regular hospital bed. Had to had surgery on spleen. Doing better now just very sore.
Froggy: The only visible damage to the frame is just where the pod scratched it. I know there was stress on the frame though for it to pull that bearing out of it.
Kevin: Was going about 45. The left side damage is from sliding on pavement. All the front damage is from the bike hitting the end of a culvert pipe (luckily I was already off the bike and rolling down the road at that point)

that stator case held up really well with no case slider on it. did it just slide out on you how did it happen. glad your ok

Every accident is different.I had similiar damage to my fairing stay.I picked it up off the ground 30 Feet from the bike .My swingarm was scratched .My pucks were scratched.The case didnt touch.The tail was scuffed.I had a tank bag on so it saved scratching the the tank.My rear hanger rider peg broke.And the mirrors were both busted.Get well soon

Xtreme: the front end damage happened after I was off the bike. When I laid it down I came off the bike and went rolling. The bike slid off the road and the front tire hit the end of a culvert pipe.

Kevin: A rather large dog jumped in front of me with its owner standing at the roadside. I just hit the brakes and laid it down to avoid impact with the dog. The owner ended up being a real ass. I wish I would have just hit the damn thing.

Hmmmm... Once the insurance is cleared up (public spaces ongoing claim and all) and if you are OK with it, please share your experience going through insurance. Short story here has to do with how my insurance package is put together and this occurrence is spot on with a scenario I am curious about.

Will let you know. So far it sucks. Talked with the adjuster today and instead of coming to the house to look at the bike they're making me pull it to the local HD dealer so they can assess the damage and give an accurate quote.

Did the shift arm crack the case? I see a white line where the shaft goes into the housing.

If you had any witnesses it sounds like the dog owner is at fault. Therefor his insurance should pick up the tab.

I would be sending them the bill for the transport costs to the dealer why is it your responsibility they cant give you an accurate quote and need a dealer to give them prices.

I'm always cautious about riding near/past dogs... They usually try to attack due to instinct, like in the video below.

I talked my lawyer
buddy today. He said if the dog wasnt chained up and ran in front of you that is the owners fault.No dog should run free of there property.It was the dogs owners recklessness that caused the wreck.I would sue.I dont care if I get bashed for saying it.If I got up and that dog caused me to wreck.The owner would be crying as I chocked there dog to death. After that I would work on them for a little.This story really ticks me off.Just complete wrecklessness of the owner.

As a dog owner, I completely agree with Blackflash and his lawyer buddy.

As much as I despise the fact that we have become a litigious society, in this case if the dog was not properly restrained by the owner, that owner is at fault and should be held liable for the injury and property damage. Certainly there must be case-law precedent for this.

North carolina law.
Chapter 67. Dogs. Article 1. Owner's Liability.
§ 67-1. Liability for injury to livestock or fowls

If any dog, not being at the time on the premises of the owner or person having charge thereof, shall kill or injure any livestock or fowls, the owner or person having such dog in charge shall be liable for damages sustained by the injury, killing, or maiming of any livestock, and costs of suit.



§ 67-2. Permitting bitch at large

If any person owning or having any bitch shall knowingly permit her to run at large during the erotic stage of copulation he shall be guilty of a Class 3 misdemeanor.

Amended by Laws 1993, c. 539, § 529; Laws 1994 (1st Ex. Sess.), c. 24, § 14(c), eff. March 26, 1994.

§ 67-3. Sheep-killing dogs to be killed

If any person owning or having any dog that kills sheep or other domestic animals, or that kills a human being, upon satisfactory evidence of the same being made before any judge of the district court in the county, and the owner duly notified thereof, shall refuse to kill it, and shall permit such dog to go at liberty, he shall be guilty of a Class 3 misdemeanor, and the dog may be killed by anyone if found going at large.

Amended by Laws 1973, c. 108, § 24; Laws 1977, c. 597; Laws 1993, c. 539, § 530; Laws 1994 (1st Ex. Sess.), c. 24, § 14(c), eff. March 26, 1994.

§ 67-4. Failing to kill mad dog

If the owner of any dog shall know, or have good reason to believe, that his dog, or any dog belonging to any person under his control, has been bitten by a mad dog, and shall neglect or refuse immediately to kill the same, he shall forfeit and pay the sum of fifty dollars ($50.00) to him who will sue therefor; and the offender shall be liable to pay all damages which may be sustained by anyone, in his property or person, by the bite of any such dog, and shall be guilty of a Class 3 misdemeanor.

I killed a dog on my bike once felt bad but the thing shouldn't have been out. That fing thing gave me a tank slapper that scared the shyt outa me. The dog came out from between 2 parked cars I was going about 30 I hit it with the left riders peg I broke it's neck I guess. I was mainly pissed cause the guy was all p/o'd at me for killing his dog he was trying to yell at me. When I got the bike stopped and just yelled back at him I said watch your kid so he isn't next he wasn't even watching his own kid more worried about the godammed dog shytheel.
Anyway heel up bro that aint no little injury you got there.

I had a dog jump in front of me last year at 35mph.I lifted my legs at slightly brushed him.Its me or the bitch.Or were both going out with a bang.I love my dog but thats the way it goes.

I've had good luck with dogs by intentionly trying to run them down. Agressive moves on your part can change their attitude and hopefully avoid the accident as they move from "attack" mode to "flight" mode. Plus your more likely to be in the best position on the bike for the crash.

For what its worth it is damned hard to run over a dog deliberately. I've only succeeded once in about twenty tries.
