Giving a gift and then making up rules about what people can and cannot do with that gift after the fact is poor form.

I've tried to discuss this with Gunter over email several times, and he has ignored my attempts, just repeatedly sending a form letter.

Again, if anyone would like my physical address so that they can serve me with legal papers, please PM me. Then we can find out what the legal status of this software is.

Copyright - easily guessable - is the right to distribute copies of a protected work, which is naturally the right of the creator or author. Specifically for software the copyright includes not only the human readable form ("source code") but also the compiled and/or assembled machine readable instructions ("program").

Folks, this is why so many in my industry favor open source software. No one can take their ball and go home when the software is open source.

If Harley-Davidson pressured them to stop distributing ECMSpy, I can appreciate HD's position: With ECMSpy, a user could raise or remove the RPM limiter, change the fueling to be grossly lean, or effect other changes that could cause engine failures. Then the user could reflash the ECU back to factory specs and request warranty service for their grenaded or slagged motor.

Big deal Max. I can do the same thing with a SCT tuner on my mustang. Fords not pressuring anyone. I think some infringed on someone elses copyright when ecmspy was created.

Moosestang, I didn't say that the capability was unique -- just that HD might have reasons why they would prefer it not be distributed.
