In defense of those about "A Plan". I believe that this thread was started as a feeler to get a response to an idea. Now 6 days and 200+ posts later, this thread has developed into much more. That is a good thing; considering the % of positive response and amount of folks willing to donate $$$ to an idea.

We have to also remember that Ideas sometimes take time to develop to work correctly, as well as not to lose sight that the people willing to work on this are doing it on their own (This is where we say Thanks).

So as much as we are all eager to get this going, I believe that it should be approached properly (not that I know what way that is) and everyone should continue to toss in ideas that may make this work better.

Just a Thought.

Thanks, that's why I asked. No is OK with me. As GOMO said, I'm just trying to do what I can do to make $$ for this, I don't have any LOL!

One question on the stickers I've made. Only have three. Why should I send them? I havn't profited from them, nor tried to sell them? If you're not going to provide merchandise so I can put a sticker on my bike, why can't I? Yea yea yea I know Copyright. Well, I don't see a copyright on your front page...most web designers could care less, bring in more peeps to their sites. What about when SouthernMarine plastered BadWeatherBikers.com down the side of his bike. Did you have a problem there? All I'm saying is, is it copyrighted, do you really care? If the answer is yes, please put a copyright symbol on the front page.

I figured it would be enough for me to ask.

Does BadWeB need to spend sponsorship fees on an attorney instead of the maintenance and improvement of the web site?

Your example of the use by another (who by the way ASKED and was granted permission) to display "BadWeatherBikers.com" on his Buell motorcycle illustrates the whole problem with trademark infringement. Should we ever decide to market BadWeB paraphernalia to help support the web site, it will be important to retain the value and exclusivity of our name and logo. Surely you can see how unauthorized production of such items by a number of others would erode the value of a commodity that belongs not to you not anyone in particular, but to this community of Buell enthusiasts. Let one instance go and a precedent is set and then the whole, "but it was okay for so-and-so, why can't I" problem raises its ugly head.

We have ZERO problem with anyone displaying enthusiasm and support for BadWeB. What we may someday have a problem with is the precedent that some forms of that enthusiasm might set and with their effect upon the ability of the site to support itself.

Yes the logo is copyrighted. : )

One does not need to display a copyright symbol for something to be copyrighted. In fact according to the law any creative worked is copyrighted the moment it is created and the copyright usualy belongs to the creator unless thye are an employee in which case it goes to the employer.

A plan? We don't have a plan? WTF do you mean we don't have a plan? We pledge cash, we then send the cash to someone to be collected into a pool of cash. That pool then is given to the AMA as a contingency fund.

I can see the hesitation to go along with a "handshake and a smile" deal if it's just some dude that you don't know from Adam... But we're talking about Blake. Sheesh. We know where he lives if anything... What the heck is wrong with people today?

America is a very large place. I grew up in Alaska. Maybe I'm just removed from "real" american culture but I tend to trust people until they give me a reason not to. "IF you finally figure something out and get it in writing"... WTH? Now we have to spend contingency money paying for paper, postage (and maybe a lawyer) just so we can send everyone a piece of paper that says how great of a race fan you are? Maybe we should do plaques instead...

I don't mean to flame sprink specifically... But the idea that we need something "in writing" baffles me. Why can't we just pick someone to handle the money that we trust? I assume we can all trust Blake yes? I'm sure he'll get some form of receipt from the AMA. He can post a copy to the badweb.

Trademarks, etc. Usually you need to show claims of when you first used it, etc., and it is yours. It is smart to go ahead and get it trademarked and registered. That shows official good intent.
Blake is correct on protecting the logo, etc. If he shows that he is monitoring the logo, and it is only used with permission, etc. it helps keep control on the logo, and its future use. If it is not controlled, and he lets everyone use it, in different ways, it is hard to go back and get control of a logo for future use. He is just protecting the property of our identity. If he has allowed others to use the logo for profit, without charging them, then it is hard to show a case where everyone cannot use it.
It is wrong to go out and make money on other companies logos, etc. That is being done now on ebay, with the Buell logo. Folks are making up shirts, clocks, etc. and making profit off of something that is really not theirs to make money off of.
Blake is right in protecting the logo. He is not being unreasonable with this request.
We just want to sponsor a team, and show our support for the Buell brand and help those that race them.
In fact, this should be a good spin PR thing,to put out to the motorcycle magazines...We sponsored the Bonneville effort, and now the same effort that went into sponsoring Buell competition at Bonneville is spreading over to Road Racing. A very positive thing for this webbased group of enthusiasts! REX

A PLAN is coming in and saying " I've talked with the AMA and here's what we need to do. You have it all backwards. Why do I have a feeling this whole idea is going into the crapper.

Talk about impatience!

In just a few hours more than 2 days, this went from a "whaddaya think" thread to a "WHY THE F***" don't we have a business plan to give out the $50K we don't yet know how we're going to raise.

I for one am willing to give it a few days more to let saner minds prevail.

I don't toss C-notes around blindly (don't ask me about my Exes) - but am willing to let this evolve a while yet. I kinda view it as a pledge to a fundraising effort.

Just got an email from Josh at Tigershark (Latus Racing's rider) - they're committing to the FX series, just uncertain about being ready for Daytona.

I've got the links and contingency forms for WERA, CCS - they're all pretty similar.

It'd be pretty easy to Google the AMA forms or a contact to get them emailed or faxed.

Yeah Daytona is coming up quickly and as far as pre-publication deadlines for race programs, we probably have less than a month to go but I think actual deadlines for contingency sponsors can run nearly up to a couple weeks before race day.

so far what we have here is a (great) idea, a lot of enthusiasm, a fair amount of pledges (no money has changed hands), and Blake persistently taking active, concerted steps to: 1) respect BADWEB's sponsors, 2) avoid any perception of impropriety, 3) avoid any actual impropriety, 4) all in a positive way that BADWEB can collectively show its support to Buell racing.

Blake has been in contact with the AMA, and is still in contact with them, trying to figure out how to do this thing right. because he has not yet presented a "plan" doesn't mean he's not trying to come up with one, nor does it mean his intentions are dishonorable.

for the few of you that seem concerned over what Blake's actual intentions for this money might be, remember that he is the man who just declined a pretty significant cash contribution from the collective BADWEB to buy a new helmet, choosing instead to donate the money to a much worthier cause.

and for the one of you that called him a liar, i can't even begin to imagine where that came from. who do you know, in a similar capacity, who has tried harder to consistently stay on high moral and ethical ground?

Blake ain't for everybody, and there are some of his personal views i've yet to come to terms with, but for a regular BADWEB member to accuse him of being deceitful in any way, shape, or form is a mindset i cannot begin to understand.

Josh's bike is pretty fast and has alot and I mean alot of mods to it over there at Latus. They installed my motor mods. Rich at Kosco Buell (Innovative Motorcycle Tech) has enough money to run maybe a half of season in FX but thats all. He also said he is not going to run Daytona. but he is looking for some more funding.

Josh's bike sure has possibilities - he came down here not having raced at Willow and came in 3rd in heavyweight Twins race after 2 big Ducatis raced by Claudio Syskiowski and Kenny Kopecky - both with YEARS of Willow experience.

All in all a very good showing, I'd say.

That Latus/Tigershark effort really has potential but the $$$ required ... scary. Probably $100K for a season if they sell their kids into slavery.

FYI, have been calling the contingency person at AMAPR on the telephone every work-day since last Thursday... removed the rest of this sad diatribe because...

I just now got a call back! cheer I enjoyed a good informative conversation with a very helpful considerate representative of AMAPR who is in charge of administering all the contingency programs for all of their racing series.

We now have LOT's of variables to consider. We have some serious work to do! If that is the way we decide to go, through an official AMAPR contingency program, we will need to have our awards structure in place and administrative fee to AMAPR no later than two weeks prior to Daytona, if we want to offer awards for that race, I think. I am certain that the awards program however may begin at any time during the season. I'll need to get confirmation on whether the admin fees is due prior to Daytona or prior to kickoff of the awards program. Pretty sure it is prior to Daytona.

Other options are to run our own private program or to deal with the track management themselves in cases where we might want to offer a special package for a particular race, like say... during homecoming at Road America June 3-5? I kinda like that idea.

The AMAPR representative is sending their contingency package information to me. She also suggested that I might want to consider a single race scenario at Road America and is will provide contact info for the track management there.

The AMA racing events at RA in Elkheart Lake, WI are scheduled for June 3rd thru June 5th.

One important clarification, going through AMAPR reqires that the checks be written to the racers themselves. The racers may or may not have an agreement with their teams to share the proceeds.

We definitely need more funding though.

As part of the AMAPR program we would pay $1,500 for admin fees. We would write the checks to the riders according to our stated awards policy NLT 30 days following each race. We would recieve four passes for each event including paddock passes and parking. Can you say raffle? : )

Like I said, there is a LOT to consider and a short time to get it done. I thrive under pressure. : ) It's just this damn paying job thing that I gotta do that irritates me. ; )

It is interesting too that at least some word of our effort here is getting around. Talked to Rich Cronrath, the team manager of the Kosko FX team. Sounds like they are optimistic to make a showing. Rich also advised that the AMAPR contingency would go to the rider and be shared per any agreement between rider and team.

The really gratifying thing about my discussion with AMAPR was that I got no inclination that the contingency program was in any way intended to materially benefit AMAPR. On the contrary, it sure seems that it is all for the racers themselves. I did not expect that. That is very gratifying. Of course attracting racers and teams is also good for the sport and thus good for AMAPR.

KUDOS to AMAPR!



Okay, so feel free to discus/comment/criticize at will. It seems though that having pledged to support the effort will go a long way towards lending weight and legitimacy to your ideas. Yeah, that is a not so subtle hint. : )

I'm very optimistic about this.

The one drawback I can see is that with money changing hands, hopefully significant sums of money, we may need the services of a good attorney, which will just take more from our pool of funds.

Okay, discuss/comment/criticize away. But pledge first! : )

Road America is a great idea but what teams are going to follow the whole FX series???Some may just do Daytona,a maybe one or two here and there.According to Hal's team they don't know if they have the funding for the whole series.Blake I plan on contributing that is for sure.I'll be at both events Homecoming and Daytona but doesn't seem sweeter to get the team or teams the money at a Brag event and the kick off of the first Daytona start in history fo Buell??You have 3 that I know of very dependable board members that will be there.Heck probably many more. No criticizing here just my thoughts.

Yeah the way I look at it the raffling of event passes will more than cover the administration fee that the AMA charges so it amount to a free deal. Cool!

Seriously, we cannot do any form of direct sponsorship. How would NRHS or Cycle-Rama feel having BadWeB a board they have supported for some time, solicit and give money to their competition. These entities are businesses first and the racing will without any doubt help to promote their business. In case you didn't see that reasoning before, there it is. : ) Cool?
