Second time in the day I start my '08 the check engine light stays on. This morning the bike fires right, 45 degrees out. Warm up for a few minutes and off I go. Start it back up about 11 this morning the light stays on. Turn it off then start again and no light. This has happened half a dozen times in the last month. No drivability issues at all even if I ride it with the light on which I usually don't. Any ideas?

I don't have ECM spy and suppose now would be a good reason to get it before this issue becomes something real. Is ECM spy just a cable and software? What is a good vendor to purchase it from?

Assuming you still have a stock exhaust, the most likely culprit for CEL's on these bikes is the actuator for the interactive muffler valve. If it's not working properly, it will throw an intermittent CEL.

You can easily check it without any diagnostic software: Remove the outer airbox cover; the motor sits on top of the inner airbox cover. Flip the kill switch to the OFF position. Turn the ignition key on, but do NOT start the bike. Open the throttle wide open and hold there. Flip the kill switch to ON while watching the actuator. The quadrant on top should smoothly rotate, pulling the cable that goes to the muffler valve to fully open, hold there a second, and then go back to fully closed. If it doesn't move, or jumps/hesitates, or just moves a little, the gears inside are stripped and that's the reason for your CEL.

The earlier units used plastic gears that are prone to stripping. The latest actuators use metal gears and (hopefully) last forever. American Sport Bike is a good source for a replacement.

+1 on the above link, don't need special software, just a jumper wire. I'm not sure about the codes in that link since it refers to 05 bikes. The explanation may be okay, but just in case you don't see your number remember that the 08 and newer bikes will have more code options. If it's a different number post it here and we'll let you know what it means.

+1 on the a sticky exhaust actuator. Mine did that for awhile intermittently.

You could also try oiling the cable and mechanism, might make it go away ... could be an easy fix.
