Because it doesn't meet EPA regulations for use on public roads.

It's not aimed at you, the end user. If they make you pull your seat off and check the engraving on your ECM...they're REALLY bored.

It's a loophole for the manufacturer.

Companies go through tons of certifications in order to get a motorcycle to market - CO2, NOx, and noise emissions to name just a few. They have to reproduce that software (and its results) on EVERY motorcycle they build, in order to keep the certification.

"For Race Use Only" lets them build and market a different set of parameters, without jeopardizing the certifications. "It says right on it..." lets them off the hook if an end user gets in trouble for using it on public roads. But like I said...on the municipal level, there's little to no enforcement in place.

Well...maybe in Cali. Do the folks out there have to get emissions tests on their bikes?
