Looking at some ecm's online Ive noticed there is a rubber block on the left side, I guess this is a spacer. My 08 bike never came with it. Is it needed?

If you are talking about the little spacer block that mounts on the ECM bolts to stick up towards the seat, yes, most bikes have needed them.

A lot of us have placed a second one on the other bolt. What they do is keep the seat pan from flexing down and rubbing the ECM plugs/wires. That can kill a good ECM.

I've made an aluminium arch and another arch and screwed it to the original BAS location
Home made but works great.

That block is stock on the 08's so somebody removed yours. Has your ECM been relocated from it's original position? Like everyone says, the seat is the issue and something needs to be done to prevent contact. Do a search just in the "Big, bad & dirty" forum and you should find a lot of creative solutions.

Here is my support:

on the second pic it shows how it's screwed to the original Bas location sensor.

Sure it rubs on the seat and is not the most perfect idea, but it works great, and it makes me sure it will never touch the ecm nor the connectors.

Or you can relocated it, which many of us have done.
