My 08 Uly belt broke at 40k in the dealer lot after unrelated service, any one know for sure if the belt is covered by warranty?

Its up to your dealer to decide, but if you got the stone guards on and its clear you didn't cut it, it should be covered.

Drive Belt Warranty
Belts that fail on a vehicle within the 24 month limited warranty period due to manufacturing defect are covered parts and labor.
Belts that fail due to stone/debris contact, while the vehicle is within the 24 month limited warranty, and it is equipped with either the original belt/stone guard, or a Harley-DavidsonŽ/BuellŽ Accessory belt/stone guard, are also covered parts and labor.
Belts that fail due to incorrect installation, misuse, abuse, stone damage due to non-Harley-DavidsonŽ/BuellŽ stone guards, or normal wear and tear are not covered under warranty.

My 2008 belt crapped out at just 16,000.
They covered it without a hassle.
